All Firefighter equipment and vehicles specified in this Purchase Order shall be delivered to the Central Firefighter Station located in the Commune de Gombe, Kinshasa, DR Congo. The supplier is responsible for all international shipping from Rotterdam, The Netherlands, to the Port of Matadi, DR Congo, including customs clearance, inland transport along the Matadi–Kinshasa corridor, and final delivery to the designated Firefighter facility in Kinshasa. Delivery must be completed no later than 15 September 2025. The supplier shall provide a detailed shipping manifest, bill of lading, certificate of origin, and all documentation required by the Direction Générale des Douanes du Congo for import into DR Congo Kinshasa. All Firefighter vehicles must be right-hand drive compliant with local DR Congo traffic regulations and must be registered with the Kinshasa municipal transport authority prior to handover.
5. Terms and Conditions- This Purchase Order constitutes a binding agreement between the Firefighter Directorate of DR Congo Kinshasa and the named supplier for the procurement of all listed Firefighter equipment, vehicles, and training materials.
- All Firefighter equipment must comply with EN, NFPA, and ISO standards as specified in the line items. The supplier shall provide certificates of conformity and test reports for every Firefighter product delivered to Kinshasa, DR Congo.
- Payment shall be made in United States Dollars (USD) via irrevocable letter of credit issued by BCC, Kinshasa, DR Congo, within 45 days of confirmed receipt and acceptance of all Firefighter goods at the Kinshasa receiving facility.
- A 10% retention shall be withheld from the final payment until a 90-day performance warranty period has elapsed without defect in any Firefighter equipment.
- The supplier shall provide a minimum 24-month warranty on all Firefighter equipment and 36-month warranty on Firefighter vehicles, covering parts and labor, with on-site service support in DR Congo Kinshasa.
- Any delay in delivery beyond the stipulated deadline of 15 September 2025 shall incur a penalty of 0.5% of the total Purchase Order value per calendar day of delay, up to a maximum of 10%.
- All Firefighter training kits and mannequins shall be accompanied by bilingual (French/English) instruction manuals suitable for the Firefighter Academy in Kinshasa, DR Congo.
- This Purchase Order is governed by the laws of the Democratic Republic of the Congo. Any disputes shall be resolved through arbitration in Kinshasa, DR Congo, in accordance with the rules of the OHADA arbitration court.
- The supplier acknowledges that all Firefighter equipment is intended for public safety operations in DR Congo Kinshasa and shall not be diverted, resold, or transferred to any third party without written authorization from the Firefighter Directorate.
