All firefighter equipment listed in this Purchase Order shall be delivered to the following locations within the Lyon metropolitan area (Métropole de Lyon, Département du Rhône, Région Auvergne-Rhône-Alpes, France):
Primary delivery point: Centre de Commandement et de Contrôle (C2), 20 quai Charles de Gaulle, 69007 Lyon. Secondary distribution points include the fire stations (casernes) in Lyon 1er, Lyon 2e, Lyon 3e, Lyon 4e, Lyon 5e, Lyon 6e, Lyon 7e, Lyon 8e, Lyon 9e, and Lyon 10e arrondissements. The supplier is responsible for all transportation, insurance, and handling costs within the France Lyon jurisdiction. Delivery must be completed no later than 15 August 2025 to ensure full operational readiness of the firefighter corps ahead of the peak summer fire season in the Lyon basin.
- This Purchase Order is governed by the French Public Procurement Code (Code de la commande publique) and applicable European Union directives. All transactions are subject to the laws of the French Republic.
- All firefighter equipment must comply with current European Norms (EN) and French National Standards (NF) as specified in the line items. The supplier warrants that all products carry valid CE marking and, where applicable, ARPP certification for radio equipment.
- The supplier shall provide a minimum five (5) year warranty on all structural firefighter protective gear and a three (3) year warranty on electronic and mechanical components. Warranty service shall be performed at the Lyon fire stations or at the supplier's facility in France Lyon.
- Payment shall be made by bank transfer (virement bancaire) to the supplier's designated account within forty-five (45) calendar days of receipt of a valid invoice, subject to satisfactory inspection and acceptance of the delivered firefighter equipment by the Métropole de Lyon technical team.
- The supplier shall maintain a dedicated after-sales support desk accessible to Lyon firefighter personnel during all operational hours. Response time for critical equipment failures (e.g., SCBA malfunction) shall not exceed four (4) hours.
- Any modification to this Purchase Order, including changes to quantities, specifications, or delivery schedules for the firefighter equipment, must be made in writing and signed by both parties. Verbal agreements are not binding.
- The supplier shall comply with all French occupational health and safety regulations (Code du travail, Livre IV) and shall provide Material Safety Data Sheets (Fiches de Sécurité) for all chemical and composite materials included in the firefighter gear.
- In the event of non-delivery or defective goods, the Métropole de Lyon reserves the right to withhold payment, demand replacement within ten (10) business days, or terminate this Purchase Order with a penalty of 0.5% of the affected line item value per day of delay, up to a maximum of 10%.
- All personal data processed under this Purchase Order shall comply with the French Data Protection Act and the EU General Data Protection Regulation (GDPR / RGPD).
- This Purchase Order constitutes the entire agreement between the parties regarding the procurement of firefighter equipment and services for the France Lyon jurisdiction and supersedes all prior negotiations, representations, or agreements.
