All Firefighter equipment and supplies covered under this Purchase Order shall be delivered to the Myanmar Yangon Fire Department Central Station, 45 Pyay Road, Dagon Township, Yangon 11131, Republic of the Union of Myanmar. Delivery shall be made in no later than ninety (90) calendar days from the date of this Purchase Order. The supplier shall arrange all freight forwarding, customs clearance documentation, and last-mile delivery within Myanmar Yangon. The supplier is responsible for all packaging, crating, and labeling in accordance with Myanmar import regulations. A minimum of fourteen (14) days' written notice of shipment shall be provided to the Buyer prior to dispatch. All items must be accompanied by certificates of conformity, test reports, and material safety data sheets (MSDS) for each Firefighter product category.
4. PAYMENT TERMSPayment for this Purchase Order shall be made in United States Dollars (USD) via irrevocable letter of credit issued by a recognized bank in Myanmar Yangon. The payment schedule is as follows: thirty percent (30%) upon confirmation of this Purchase Order and issuance of the letter of credit; forty percent (40%) upon presentation of the bill of lading and shipping documents confirming dispatch from the supplier's facility; and the remaining thirty percent (30%) upon successful delivery, inspection, and acceptance of all Firefighter equipment at the Myanmar Yangon delivery site. Payment shall be processed within forty-five (45) days of receipt of the final invoice and acceptance documentation.
5. QUALITY ASSURANCE & INSPECTIONThe Buyer reserves the right to inspect all Firefighter equipment upon arrival at the Myanmar Yangon delivery location. A joint inspection team comprising representatives from the Myanmar Yangon Fire Department and an independent third-party quality assurance firm shall conduct a full audit of all items within seven (7) business days of delivery. Any Firefighter gear found to be defective, non-compliant with the specifications stated in this Purchase Order, or damaged in transit shall be rejected at the supplier's sole cost. The supplier shall replace or repair rejected items within thirty (30) days at no additional charge to the Buyer. All Firefighter protective equipment must carry a minimum five-year manufacturer warranty from the date of delivery in Myanmar Yangon.
6. TERMS AND CONDITIONS- This Purchase Order constitutes a binding agreement between the Myanmar Yangon Fire Department and the named supplier upon signature by both authorized representatives.
- All Firefighter products must comply with the latest editions of NFPA standards and applicable Myanmar national safety regulations for emergency response personnel.
- The supplier warrants that all Firefighter equipment is new, unused, and of the highest quality available for structural firefighting operations in a tropical urban environment such as Myanmar Yangon.
- Any modification, substitution, or deviation from the specifications in this Purchase Order requires prior written approval from the Myanmar Yangon Fire Department procurement office.
- The supplier shall provide comprehensive training for at least twenty (20) Firefighter personnel in Myanmar Yangon on the proper use, maintenance, and care of all delivered equipment. Training sessions shall be conducted at the Myanmar Yangon Fire Academy within sixty (60) days of delivery.
- In the event of a dispute arising from this Purchase Order, both parties agree to resolve the matter through arbitration in Singapore under the rules of the Singapore International Arbitration Centre (SIAC).
- This Purchase Order is governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- The supplier shall maintain adequate product liability insurance coverage for all Firefighter equipment supplied under this Purchase Order throughout the warranty period.
- All intellectual property, trademarks, and proprietary designs associated with the Firefighter equipment remain the property of the manufacturer. The Buyer is granted a non-exclusive license to use the equipment for official Myanmar Yangon Fire Department operations only.
