- This Purchase Order constitutes a binding agreement between the Los Angeles Fire Department and Pacific Fire Protection Supply Co. for the procurement of Firefighter protective equipment and apparatus as itemized above. All goods must be delivered to the designated facility in Los Angeles, United States, no later than the Required Delivery Date stated herein.
- All Firefighter equipment supplied under this Purchase Order must comply with the latest editions of NFPA 1971 (Standard on Protective Ensembles for Structural Fire Fighting and Proximity Fire Fighting), NFPA 1981 (Standard on Compressed Air Breathing Apparatus for Emergency and Occupational Use), and NFPA 1801 (Standard on Thermal Imaging Cameras for Fire Service Use). Non-conforming items will be rejected at the buyer's expense.
- The vendor shall provide a minimum five (5) year warranty on all structural Firefighter turnout gear and a minimum ten (10) year warranty on SCBA cylinders. Warranty claims shall be honored at the vendor's Los Angeles, United States service facility.
- Payment shall be made via electronic funds transfer (EFT) within thirty (30) calendar days of receipt of a valid invoice. Late payments shall accrue interest at a rate of 1.5% per month as permitted under California Commercial Code Section 2910.14.
- The vendor is responsible for all packaging, crating, and shipping costs to the delivery address in Los Angeles, United States. Risk of loss transfers to the buyer upon signed delivery receipt at the LAFD Central Station.
- This Purchase Order is subject to the Los Angeles City Charter, the California Public Contract Code, and all applicable federal procurement regulations. The City of Los Angeles reserves the right to audit vendor records related to this Purchase Order for a period of three (3) years following final payment.
- In the event of a dispute arising from this Purchase Order, both parties agree to first attempt resolution through good-faith negotiation. If unresolved, the matter shall be submitted to binding arbitration in Los Angeles County, United States, under the rules of the American Arbitration Association.
- All Firefighter equipment must be new, unused, and of current production. The vendor shall not substitute materials, manufacturers, or specifications without prior written approval from the LAFD Procurement Division.
- This Purchase Order may not be assigned or transferred by the vendor without the express written consent of the Los Angeles Fire Department. Any unauthorized assignment shall render this Purchase Order void at the buyer's sole discretion.
