1. Scope of Purchase Order: This Purchase Order covers the supply, packaging, and delivery of all listed Firefighter equipment to the designated Miami, Florida receiving location. The supplier acknowledges that all items are intended for active-duty Firefighter personnel serving the United States Miami metropolitan fire district.
2. Quality and Compliance: All Firefighter gear must meet or exceed the specifications outlined in NFPA 1971, NFPA 1982, and applicable OSHA regulations. The supplier shall provide certificates of compliance and material safety data sheets (MSDS) with each shipment. Any Firefighter equipment found non-compliant upon inspection will be rejected at the supplier's expense.
3. Delivery and Acceptance: Delivery shall be made to the Miami Fire Station 12 address listed above. The City of Miami Fire Rescue Department reserves the right to inspect all Firefighter equipment within ten (10) business days of delivery. Acceptance does not waive any latent defect claims.
4. Payment: Payment of the full Purchase Order amount shall be remitted via electronic funds transfer (EFT) to the supplier's designated account within forty-five (45) days of receipt of a valid invoice and confirmed acceptance of goods. Late payments shall accrue interest at 1.5% per month.
5. Warranties: The supplier warrants that all Firefighter equipment is new, free from defects in material and workmanship, and shall provide a minimum two-year warranty on structural gear and a five-year warranty on SCBA cylinders. Warranty claims shall be honored at the supplier's cost, including return shipping to the United States Miami facility.
6. Cancellation: The City of Miami Fire Rescue Department may cancel this Purchase Order in whole or in part by written notice. In the event of cancellation, the supplier shall be compensated for materials already procured and non-cancellable production costs, up to a maximum of 25% of the total Purchase Order value.
7. Governing Law: This Purchase Order shall be governed by the laws of the State of Florida and the federal laws of the United States. Any disputes shall be resolved in the courts of Miami-Dade County, Florida, United States Miami jurisdiction.
8. Insurance: The supplier shall maintain commercial general liability insurance of not less than $2,000,000 per occurrence and $5,000,000 aggregate, naming the City of Miami as an additional insured, for the duration of this Purchase Order.
