This Purchase Order is issued by Deccan Infrastructure & Development Pvt. - Acceptance: This Purchase Order shall become a binding contract upon written acceptance by the Geologist within seven (7) calendar days of the date of issue. The Geologist must sign and return a copy of this document to the Procurement Department at Nariman Point, Mumbai.
- Qualifications: The Geologist engaged under this Purchase Order must hold a minimum of a Master's degree in Geology or Engineering Geology from a university recognized by the University Grants Commission (UGC) of India, and must be registered with the Geological Society of India (GSI) or an equivalent professional body.
- Compliance with Mumbai Regulations: All fieldwork conducted by the Geologist at the BKC site in Mumbai shall comply with the Mumbai Municipal Corporation (MMC) environmental clearance norms, the Maharashtra Pollution Control Board (MPCB) guidelines, and the National Building Code of India (NBC) 2016, Part 5 (Soils and Foundations).
- Timeline: The Geologist shall complete all field investigations within forty-five (45) calendar days from the commencement date of 01 July 2025. The final Geological Investigation Report shall be submitted within ten (10) working days of fieldwork completion.
- Payment Schedule: 25% advance upon acceptance of this Purchase Order; 50% upon completion of all fieldwork and submission of preliminary data; 25% upon acceptance of the final report by the project structural engineer. All payments shall be processed within thirty (30) days of a valid invoice received at the Mumbai office.
- Intellectual Property: All geological data, borehole logs, laboratory reports, and the final GIR produced by the Geologist under this Purchase Order shall become the exclusive property of Deccan Infrastructure & Development Pvt. Ltd. The Geologist shall not reuse or disclose the data to any third party without written consent.
- Insurance: The Geologist shall maintain valid professional indemnity insurance of not less than INR 50,00,000 (Fifty Lakh Rupees) and personal accident coverage for all field personnel working in Mumbai throughout the duration of this engagement.
- Force Majeure: Neither party shall be liable for delays caused by natural disasters (including monsoon flooding common in Mumbai), government-mandated lockdowns, or acts of God, provided written notice is given within 48 hours of the event.
- Dispute Resolution: Any dispute arising out of or in connection with this Purchase Order shall be resolved by arbitration in Mumbai, Maharashtra, India, in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, and the language of arbitration shall be English.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of India, specifically the Indian Contract Act, 1872, and the applicable state laws of Maharashtra.
