This Purchase Order authorises the engagement of a qualified Geologist to conduct comprehensive geological survey, assessment, and reporting services across the Wellington region, New Zealand. The Geologist shall perform all duties in accordance with the New Zealand Geotechnical Society (NZGS) Code of Practice, the Resource Management Act 1991, and all applicable local council bylaws administered by the Wellington City Council and the Greater Wellington Regional Council. The work area encompasses the Wellington Basin, the Rimutaka Range foothills, the Hutt Valley, and the coastal geology of the Wellington Harbour (Te Moana-o-Taranaki) and the eastern seaboard extending to Kapiti Coast.

  1. Compliance with New Zealand Legislation: The Geologist and the vendor shall comply with all applicable New Zealand legislation, including the Resource Management Act 1991, the Health and Safety at Work Act 2015, the Building Act 2004, and the Local Government Act 2002. All fieldwork in the Wellington region shall be conducted in accordance with Wellington City Council and Greater Wellington Regional Council permits and conditions.
  2. Professional Standards: The Geologist shall adhere to the Code of Ethics and Professional Conduct of the Geological Society of New Zealand (GSNZ) and the New Zealand Geotechnical Society (NZGS). All reports shall be signed and sealed by a registered Geologist holding a valid GSNZ membership.
  3. Site Access and Safety: The Geologist shall obtain all necessary site access permissions from Wellington City Council, landowners, and relevant Māori iwi (including Te Āti Awa and Ngāti Toa Rangatira) prior to commencing fieldwork in the Wellington area. A site-specific Health and Safety Plan shall be submitted to the Wellington Geological Survey Authority no later than 5 business days before commencement.
  4. Payment Schedule: Payment shall be made in three (3) instalments: 30% upon acceptance of this Purchase Order, 40% upon submission of the draft Geological Investigation Report, and 30% upon final acceptance of all deliverables. All invoices shall be submitted in New Zealand Dollars (NZD) and include GST at the prevailing rate of 15%.
  5. Intellectual Property: All geological data, reports, maps, and analyses produced under this Purchase Order shall become the property of the Wellington Geological Survey Authority upon full payment. The Geologist retains the right to reference the project in professional portfolios subject to a 12-month confidentiality period.
  6. Waiora / Environmental Considerations: The Geologist shall conduct all field investigations in a manner that minimises environmental disturbance to the Wellington Harbour, the Hutt River, and any identified wāhi tapu (sacred sites) in the Wellington region. Any discovery of significant geological or archaeological features shall be reported immediately to the Wellington City Council and the Department of Conservation (DOC).
  7. Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved in accordance with the New Zealand Disputes Tribunal Act 1945 or, where the amount exceeds NZD 25,000, by arbitration under the Arbitration Act 1996, with proceedings conducted in Wellington, New Zealand.
  8. Termination: Either party may terminate this Purchase Order with 14 days written notice. In the event of termination, the Geologist shall be compensated for all work completed and materials procured up to the date of termination.
