- This Purchase Order constitutes a binding procurement instrument issued by Andina Corporations S.A.C. for the engagement of a Human Resources Manager professional and associated services. Acceptance of this Purchase Order by the vendor signifies full agreement to all terms herein.
- The Human Resources Manager shall be engaged under a fixed-term labor contract of twelve (12) months, renewable by mutual written agreement, in strict compliance with the Peruvian Labor Code (Legislative Decree No. 728) and all applicable regulations enforced in Peru Lima.
- All compensation, benefits, and statutory contributions (ESSALUD, AFP/ONP, CTS, gratificaciones, and 13th-month bonus) shall be calculated and remitted in accordance with Peruvian labor law as applicable to employees based in Lima, Peru.
- The vendor shall guarantee that the Human Resources Manager candidate meets all qualifications specified in Line Item 1. Failure to meet these qualifications within the first 90-day probationary period shall entitle the buyer to terminate the engagement without penalty and request a full refund of the recruitment fee.
- Payment shall be made in Peruvian Soles (PEN) via electronic bank transfer to the vendor's account registered in Lima, Peru. Invoices must include the vendor's RUC number, IGV breakdown, and a reference to this Purchase Order number (PO-2025-LIM-00487).
- The vendor shall maintain full confidentiality regarding all proprietary information, employee data, and internal HR strategies of Andina Corporations S.A.C. in compliance with Peru's Personal Data Protection Law (Law No. 29733) and the regulations issued by the Data Protection Authority (Autoridad Nacional de Protección de Datos Personales).
- Any disputes arising from this Purchase Order shall be resolved through binding arbitration in Lima, Peru, in accordance with the rules of the Lima Chamber of Commerce (Cámara de Comercio de Lima), and governed by the commercial and labor laws of the Republic of Peru.
- This Purchase Order is valid for thirty (30) calendar days from the date of issue. The vendor must confirm acceptance in writing within ten (10) business days of receipt. Failure to confirm within this period shall render this Purchase Order null and void.
- The Human Resources Manager shall report directly to the General Director of Andina Corporations S.A.C. and shall conduct all duties from the company's principal office in San Isidro, Lima, Peru, unless otherwise authorized in writing by the General Director.
- All deliverables, reports, and documentation produced by the Human Resources Manager in the course of this engagement shall be the exclusive property of Andina Corporations S.A.C. and shall be prepared in Spanish, with English translations available upon request, reflecting the bilingual operational environment of Peru Lima.
