- 5.1 This Purchase Order is governed by and shall be interpreted in accordance with the laws of the Kingdom of Spain, with specific application to the autonomous community of the Comunitat Valenciana, Spain Valencia. Any disputes arising from this Purchase Order shall be submitted to the competent courts of Valencia, Spain.
- 5.2 The vendor warrants that the Human Resources Manager candidate presented shall meet all qualifications, experience, and competency requirements specified in the job description annexed to this Purchase Order. A guarantee period of 6 months applies from the date of commencement.
- 5.3 The employment contract for the Human Resources Manager shall comply fully with the Estatuto de los Trabajadores (Royal Legislative Decree 2/2015), the applicable collective agreement for the Comunitat Valenciana, and all regulations issued by the Conselleria de Treball, Afers Socials i Qualitat de Vida of the Generalitat Valenciana.
- 5.4 The vendor shall ensure full compliance with Spain's data protection legislation (LOPDGDD 3/2018) and the EU General Data Protection Regulation (GDPR) in the processing of all candidate personal data during the recruitment process for the Human Resources Manager position.
- 5.5 This Purchase Order shall remain valid for 60 calendar days from the date of issue. Acceptance must be confirmed in writing by the vendor within 10 business days.
- 5.6 The vendor shall maintain professional indemnity insurance with a minimum coverage of €1,000,000, valid throughout the territory of Spain, including the Valencia region, for the duration of the engagement.
- 5.7 Any modifications to this Purchase Order must be agreed upon in writing by both parties and countersigned by the authorised representatives of each entity.
