4. TERMS AND CONDITIONS
- This Purchase Order is issued under the authority of the Judge of the Superior Court of Justice, Judicial District of Colombia Bogotá, and constitutes a binding commitment for the procurement of the goods and services herein described.
- The Supplier shall deliver all physical goods to the Judicial Palace located at Carrera 13 No. 37-15, Colombia Bogotá, D.C., no later than the required delivery date specified in Section 2. All delivery costs, including transportation, insurance, and installation, are included in the unit prices stated in this Purchase Order.
- Payment shall be made via electronic bank transfer (transferencia electrónica) to the account designated by the Supplier, within thirty (30) calendar days from the date of receipt of a valid invoice (factura electrónica) conforming to the requirements of the Colombian tax authority (DIAN).
- The Supplier warrants that all goods delivered under this Purchase Order shall be new, of the highest quality, and free from defects. A warranty period of no less than twelve (12) months shall apply to all physical items, and all services shall be rendered in accordance with the professional standards established by Colombian law.
- The Judge's office reserves the right to inspect and verify all goods and services upon delivery. Any item found to be non-conforming with the specifications in this Purchase Order shall be replaced or repaired at the Supplier's sole expense within five (5) business days.
- All personal data processed in connection with this Purchase Order shall be handled in strict compliance with Ley 1581 de 2012 (Colombian Data Protection Law) and the regulations of the Colombian Judicial Branch regarding the confidentiality of judicial proceedings.
- This Purchase Order is governed by the laws of the Republic of Colombia. Any dispute arising from this Purchase Order shall be submitted to the competent administrative courts of Colombia Bogotá, D.C., in accordance with the Colombian Code of Administrative and Contentious Procedure (Código de Procedimiento Administrativo y de lo Contencioso Administrativo).
- The Supplier acknowledges that this Purchase Order is subject to audit by the Comptroller General of the Republic of Colombia (Contraloría General de la República) and the Attorney General's Office (Procuraduría General de la Nación) as part of the oversight of public judicial expenditures.
- Any modifications to this Purchase Order must be made in writing and signed by the Judge or the Judge's designated administrative delegate. Verbal agreements or informal communications shall not constitute valid amendments to this document.
- This Purchase Order becomes effective upon the signature of the Judge and the written acceptance by the Supplier. It shall remain in full force and effect until all obligations herein have been fully satisfied.
5. AUTHORIZATION AND SIGNATURES
I, the undersigned Judge of the Superior Court of Justice, Judicial District of Colombia Bogotá, Republic of Colombia, hereby authorize and approve this Purchase Order for the procurement of the goods and services described herein, in the exercise of my administrative and judicial functions, and in full compliance with the applicable Colombian public procurement regulations.
