4. Delivery Terms
All goods specified in this Purchase Order shall be delivered to the Bombay High Court premises, Fort, India Mumbai, within thirty (30) calendar days from the date of this order. Delivery shall be made between 09:00 AM and 04:00 PM on working days. The supplier shall bear all costs of transportation, insurance, and packaging. Each item shall be individually labeled with the Judge's name, designation, and courtroom number as directed by the Registrar (Administration). Partial deliveries are not permitted unless expressly authorized in writing by the Buyer.
5. Payment Terms
Payment shall be made via RTGS/NEFT to the supplier's designated bank account within forty-five (45) days of successful delivery and acceptance of goods. The Buyer shall withhold a retention sum of ten percent (10%) until the expiry of the defect liability period of one hundred and eighty (180) days. All invoices must reference this Purchase Order number (BHC/JUD/2025/0472) and shall be accompanied by a valid GST tax invoice, delivery challan, and certificate of conformity. No payment shall be processed without a signed Goods Received Note (GRN) from the receiving authority at the India Mumbai court complex.
6. Terms and Conditions
- This Purchase Order is governed by the laws of the Republic of India and shall be subject to the jurisdiction of the courts in India Mumbai, Maharashtra.
- All Judge's robes and ceremonial garments shall be inspected by the Court's designated quality officer prior to acceptance. Any item found to be defective, of inferior quality, or not conforming to the prescribed specifications shall be rejected at the supplier's sole cost.
- The supplier warrants that all goods are new, unused, and free from any encumbrance. The supplier shall provide a minimum warranty of two (2) years on furniture items and one (1) year on textile and accessory items.
- The supplier shall comply with all applicable labour laws of India, including the Factories Act, 1948, and the Minimum Wages Act, 1948, in the manufacture and supply of goods.
- Any dispute arising out of or in connection with this Purchase Order shall be resolved by arbitration in India Mumbai in accordance with the Arbitration and Conciliation Act, 1996, as amended.
- The Buyer reserves the right to cancel, modify, or amend this Purchase Order in whole or in part at any time prior to dispatch, without incurring any liability to the supplier.
- The supplier shall maintain complete confidentiality regarding the identity and designation of the Judge for whom specific items are procured, in accordance with the Official Secrets Act, 1923, and court protocol regulations.
- Force majeure events, including but not limited to natural disasters, government-imposed lockdowns, or acts of war, shall extend the delivery timeline proportionally, subject to written notification within forty-eight (48) hours of the event.
- All goods shall be packaged in secure, moisture-proof containers suitable for long-term storage. Textile items shall be packed in acid-free tissue paper within rigid cardboard boxes.
- The supplier shall provide a detailed packing list and a certificate of origin for each consignment delivered to the India Mumbai court premises.
7. Acceptance and Authorization
This Purchase Order is issued under the authority of the Registrar (Administration), Bombay High Court, India Mumbai, and is binding upon both parties upon signature. The supplier's acceptance of this order shall be confirmed in writing within seven (7) working days of receipt. Failure to confirm within the stipulated period shall be construed as a rejection of this Purchase Order.
