TERMS AND CONDITIONS OF THIS PURCHASE ORDER
- Delivery: The Supplier shall deliver all items listed in this Purchase Order to the Office of the Hon'ble Judge at Tis Hazari Court Complex, New Delhi – 110001, India, within thirty (30) calendar days from the date of this Purchase Order. Delivery shall be made between 09:00 AM and 05:00 PM, Monday to Friday, subject to court security protocols.
- Payment Terms: Payment shall be made via RTGS/NEFT to the Supplier's designated bank account within fifteen (15) days of successful delivery, installation, and written acceptance by the Court Registrar. A valid GST invoice shall accompany each delivery. No advance payment shall be made.
- Quality and Compliance: All furniture and equipment must comply with the specifications issued by the Delhi High Court Administration and the All India Judges' Association guidelines. The Judge's bench, chair, and official attire must conform to the traditional judicial standards of India. Electronic systems must be compatible with the eCourts infrastructure of the National Judicial Data Grid.
- Warranty: The Supplier shall provide a minimum warranty of two (2) years on all furniture items, three (3) years on electronic equipment, and one (1) year on the sound system and security kit. Warranty claims shall be serviced within seven (7) working days at the Supplier's cost.
- Installation: The Supplier is responsible for the complete installation, configuration, and commissioning of all electronic equipment, the sound system, and the security surveillance kit in the Judge's chamber and courtroom. Installation shall be completed within five (5) days of physical delivery.
- Security Clearance: All personnel of the Supplier entering the court premises in New Delhi must obtain prior security clearance from the Delhi Police Court Security Wing. No item shall be brought into the Judge's chamber without prior inspection by the court security staff.
- Penalty for Delay: In the event of delayed delivery beyond the stipulated period, a penalty of 0.5% of the total Purchase Order value per day of delay shall be deducted from the payment, up to a maximum of 10% of the total value.
- Rejection: The Buyer reserves the right to reject any item that does not meet the specified quality, material, or dimensional requirements. Rejected items shall be replaced by the Supplier within ten (10) days at no additional cost.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of India, specifically the Government Procurement Rules of the National Capital Territory of Delhi and the applicable provisions of the Indian Contract Act, 1872. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
- Confidentiality: The Supplier shall maintain strict confidentiality regarding the identity of the Judge, the nature of cases being heard, and all judicial proceedings. Any breach of confidentiality shall result in immediate termination of this Purchase Order and legal action under the Indian Penal Code.
- Tax Compliance: All applicable taxes, including Goods and Services Tax (GST) as per the Central Goods and Services Tax Act, 2017, shall be borne as specified. The Supplier shall provide a valid GST invoice with all mandatory details as per the Indian tax regulations.
