Terms and Conditions of This Purchase Order
- Delivery: All items specified in this Purchase Order shall be delivered to the High Court of Malaya, Menara Keadilan, Kuala Lumpur, Malaysia. Delivery must be completed no later than 15 August 2025. The supplier is responsible for all transportation, insurance, and handling costs within Malaysia Kuala Lumpur.
- Payment Terms: Payment shall be made within thirty (30) days from the date of confirmed delivery and acceptance of all Judge equipment by the Chief Registrar. Payment shall be made via bank transfer to the supplier's designated account. A 5% retention shall be withheld until the warranty period commences.
- Quality Assurance: All Judge-specific items, including the Judge's bench, gavel, robes, and seals, must meet the specifications outlined in Annexure A of this Purchase Order. The buyer reserves the right to reject any item that does not conform to the agreed specifications or the Malaysian Standards (MS) for judicial furnishings.
- Warranty: The supplier warrants that all Judge equipment is free from defects in materials and workmanship for a period of three (3) years from the date of installation. Any defects discovered during this warranty period shall be repaired or replaced at no additional cost to the buyer.
- Compliance: This Purchase Order is governed by the laws of Malaysia. All transactions shall comply with the Malaysian Government Procurement Guidelines 2024 and the Federal Government Financial Regulations 1956. The supplier confirms that all items are sourced legally and comply with Malaysian import and customs regulations where applicable.
- Confidentiality: The supplier acknowledges that this Purchase Order relates to the judicial branch of the Malaysian government. All information pertaining to the Judge's office, courtroom layout, and security arrangements must be treated as strictly confidential and shall not be disclosed to any third party without written consent from the Ministry of Justice of Malaysia.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation in Kuala Lumpur, Malaysia, in accordance with the rules of the Malaysian Mediation Centre. If mediation fails, disputes shall be referred to the courts of Malaysia Kuala Lumpur.
- Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to events beyond reasonable control, including but not limited to natural disasters, government directives, or civil unrest in Malaysia.
