The Supplier shall deliver all items listed in Section 3 to the Palacio de Justicia, Jr. de la Unión 112, Cercado de Lima, Peru, no later than 30 June 2025. Delivery shall be made between 08:00 and 16:00 hours on business days. The Supplier is responsible for all transportation, insurance, and handling costs within the Lima metropolitan area. Installation and calibration services (Item 10) shall be performed on-site within five (5) business days of delivery. The Judge’s office shall designate a receiving officer to inspect all goods upon arrival and sign the delivery receipt. Any discrepancies, damages, or non-conformities must be reported within forty-eight (48) hours of delivery.
5. PAYMENT TERMSPayment shall be made in Peruvian Soles (PEN) via bank transfer to the Supplier’s designated account. The Buyer shall issue a single payment within fifteen (15) business days following the successful delivery, inspection, and acceptance of all goods and services. The Supplier must present a valid Factura Electrónica (Electronic Invoice) compliant with the SUNAT (Superintendencia Nacional de Aduanas y de Administración Tributaria) regulations. Late payments shall accrue interest at the rate established by the Central Reserve Bank of Peru (BCRP).
6. TERMS AND CONDITIONS- This Purchase Order is governed by the laws of the Republic of Peru, including the Public Procurement Law (Ley Nº 30225) and its Regulations, as well as the applicable norms of the Power Judicial of Peru.
- All goods must be new, of the highest quality, and free from defects. The Supplier warrants all items for a minimum period of two (2) years from the date of acceptance.
- The Supplier shall comply with all labor, tax, and environmental regulations in force in Peru. The Supplier certifies that it is in good standing with SUNAT, the Ministry of Labor, and the National Superintendency of Public Procurement (OSCE).
- Any modification to this Purchase Order must be made in writing and signed by both parties. Verbal agreements shall have no legal effect.
- In the event of a dispute, the parties shall first attempt resolution through amicable negotiation. Failing that, the dispute shall be submitted to the competent courts of Lima, Peru, and the parties waive any other jurisdiction.
- The Supplier shall maintain strict confidentiality regarding the identity of the Judge, the nature of the cases handled, and any information obtained in the course of fulfilling this Purchase Order.
- This Purchase Order becomes effective upon signature by both parties and remains valid until full performance of all obligations herein.
