The Laboratory Technician personnel shall commence duties no later than 1 August 2025 at the buyer's primary laboratory facility situated at Level 4, 120 Creek Street, Brisbane, Queensland 4000, Australia Brisbane. The supplier is required to confirm in writing, via email to the buyer's procurement office, that all Laboratory Technician candidates have passed national police checks, occupational health assessments, and hold current Australian Working Rights verification no fewer than fourteen (14) business days prior to the commencement date.
- This Purchase Order is governed by the laws of the State of Queensland and the Commonwealth of Australia. Any disputes arising from this Purchase Order shall be resolved in accordance with the Australian Consumer Law (2010) and the Queensland Civil and Administrative Tribunal (QCAT) procedures.
- The supplier warrants that all Laboratory Technician personnel engaged under this Purchase Order hold valid qualifications recognised by the relevant Australian credentialing bodies and maintain current registration where applicable.
- All Laboratory Technician staff must comply with the buyer's internal laboratory safety protocols, the Queensland Health Act 1969, and the National Standard for the Management of Occupational Exposure to Pathogens in Healthcare (2017).
- Payment shall be made via Electronic Funds Transfer (EFT) to the supplier's nominated bank account within thirty (30) calendar days of receipt of a valid tax invoice. Late payments shall attract interest at the rate prescribed under the Queensland Interest on Late Payments of Debts Act 2003.
- The supplier shall maintain professional indemnity insurance of no less than AUD 10,000,000 and public liability insurance of no less than AUD 20,000,000 for the duration of this Purchase Order. Certificates of insurance must be provided prior to commencement.
- Either party may terminate this Purchase Order with thirty (30) days' written notice. In the event of termination, the buyer shall be liable for services rendered up to the date of termination, and the supplier shall ensure a minimum two-week transition period for any Laboratory Technician personnel to allow for knowledge transfer.
- All data and patient information handled by the Laboratory Technician personnel are subject to the Privacy Act 1988 (Cth) and the Notifiable Data Breaches scheme. The supplier shall execute the buyer's Data Protection Agreement prior to commencement.
- This Purchase Order does not constitute a permanent employment contract. The relationship between the buyer and the supplier is that of principal and contractor. The Laboratory Technician personnel are engaged by the supplier and are not employees of the buyer.
- All work performed under this Purchase Order shall be conducted in compliance with the Fair Work Act 2009 (Cth) and the applicable Queensland industrial awards, including the Health Professionals and Support Services Award 2020.
By signing below, both parties acknowledge and agree to the terms, conditions, and scope of work outlined in this Purchase Order for the provision of Laboratory Technician services in Australia Brisbane. This document constitutes a binding agreement upon execution by both authorised representatives.
