Scope of Purchase – Laboratory Technician Services

This Purchase Order is issued by Atlantic Diagnostics & Research Laboratories (Pty) Ltd, a registered diagnostic facility operating in South Africa Cape Town, to procure the professional services of a qualified Laboratory Technician through the supplier MediStaff Professional Solutions (Pty) Ltd. The Laboratory Technician shall be deployed to the buyer's premises at 42 Bree Street, Cape Town, and shall perform all duties consistent with the South African National Health Act, the Occupational Health and Safety Act, and the standards set forth by the South African Health Products Regulatory Authority (SAHPRA). The Laboratory Technician must hold a minimum qualification of a National Diploma in Medical Laboratory Technology (NQF Level 6) or equivalent, registered with the South African Council for Medical Laboratory Sciences (SACMLS), and possess a valid South African professional indemnity certificate.

Terms and Conditions

1. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of South Africa, specifically the Western Cape jurisdiction in Cape Town. Any disputes arising from this Purchase Order shall be subject to the exclusive jurisdiction of the High Court of South Africa, Cape Town Division.

2. Service Commencement: All Laboratory Technician personnel shall commence their duties no later than 01 July 2025 at the buyer's premises in South Africa Cape Town. A minimum of 48 hours' written notice is required for any substitution of a Laboratory Technician by the supplier.

3. Qualification Verification: The supplier warrants that each Laboratory Technician deployed under this Purchase Order holds a valid SACMLS registration, a current South African identity document, and has passed a criminal background check as required by the Protection of Personal Information Act (POPIA) 4 of 2013.

4. Payment Schedule: Invoices shall be submitted on the last working day of each calendar month. Payment shall be made within 30 days of receipt of a valid tax invoice. Late payments shall accrue interest at the rate of 10% per annum as per the Late Payment of Interest Act 3 of 2003 (South Africa).

5. Termination: Either party may terminate this Purchase Order with 30 days' written notice. In the event of termination, the supplier shall ensure a minimum 14-day transition period for any replacement Laboratory Technician to be sourced and deployed at the South Africa Cape Town facility.

6. Confidentiality & Data Protection: All Laboratory Technician personnel shall be bound by strict confidentiality agreements in compliance with POPIA. Patient data, test results, and proprietary laboratory methodologies shall not be disclosed to any third party without written consent from the buyer.

7. Health & Safety: The supplier shall ensure that all Laboratory Technician personnel are inducted into the buyer's Occupational Health and Safety management system prior to commencing work. All incidents, near-misses, and occupational exposures shall be reported within 24 hours in accordance with the OHS Act applicable in South Africa Cape Town.

8. Performance Standards: The Laboratory Technician personnel shall maintain a minimum 98% accuracy rate on internal quality control samples and shall participate in external quality assurance (EQA) schemes administered by the South African National Quality Assurance Scheme (SANQAS).

This Purchase Order (PO-CT-2025-04871) constitutes a binding procurement document for the engagement of Laboratory Technician services at the buyer's facility in South Africa Cape Town. This document is valid for a period of twelve (12) months from the date of acceptance and may be renewed by mutual written agreement. All communications regarding this Purchase Order shall be directed to the procurement department of the buyer at the address stated above.
