Terms and Conditions
- This Purchase Order is issued in accordance with Colombian commercial law (Código de Comercio) and applies exclusively to the provision of Librarian professional services within the city of Bogotá, Colombia. All deliverables must comply with the standards established by the Biblioteca Nacional de Colombia.
- The contracted Librarian must hold a minimum of a professional degree in Library Science (Ciencias de la Información) from a recognized Colombian university and possess at least five (5) years of documented experience in academic or public library settings in Colombia.
- Payment shall be processed in Colombian Pesos (COP) via bank transfer to the vendor's designated account in Bogotá. Invoices must be submitted by the 5th business day of each month for services rendered in the preceding month. Late payments shall accrue interest at the rate established by the Banco de la República de Colombia.
- The Librarian services described in this Purchase Order are non-transferable. Any substitution of the assigned Librarian professional requires prior written approval from the Director of Procurement at Biblioteca Central de Bogotá, Colombia.
- The vendor shall ensure that the Librarian complies with all labor regulations of Colombia, including but not limited to the Código Sustantivo del Trabajo, social security contributions (Pensión, Salud, ARL), and applicable collective labor agreements in Bogotá.
- Confidentiality: The Librarian shall maintain strict confidentiality regarding patron information in accordance with the Colombian Data Protection Law (Ley 1581 de 2012) and the General Data Protection Regulation applicable in Colombia. All user data processed in Bogotá must be stored on servers located within Colombian territory.
- Termination: Either party may terminate this Purchase Order with thirty (30) days written notice. In the event of termination, the vendor shall be compensated for all Librarian services rendered up to the effective date of termination, plus a transition period of fifteen (15) days for knowledge transfer.
- Dispute resolution: Any disputes arising from this Purchase Order shall be resolved through arbitration in Bogotá, Colombia, in accordance with the rules of the Cámara de Comercio de Bogotá. The applicable law shall be the law of the Republic of Colombia.
- This Purchase Order becomes effective upon signature by both parties and remains valid for the contract duration specified herein. Amendments must be made in writing and signed by authorized representatives of both entities in Bogotá, Colombia.
