- This Purchase Order constitutes a binding agreement between the Stadtbibliothek München and the named Librarian for the provision of professional library services within the municipality of Germany Munich. All terms are governed by the laws of the Federal Republic of Germany, specifically the German Civil Code (Bürgerliches Gesetzbuch – BGB) and applicable Bavarian municipal employment regulations.
- The Librarian shall commence duties no later than 1 September 2025 and shall maintain a standard working schedule of 38.5 hours per week, Monday through Friday, in compliance with the collective bargaining agreement (Tarifvertrag) for public service employees in the state of Bavaria.
- Payment for all services rendered under this Purchase Order shall be made via bank transfer to the IBAN specified above within thirty (30) calendar days of the invoice date. Late payments shall accrue interest at the statutory rate of 8% above the European Central Bank reference rate, in accordance with § 288 of the German Civil Code.
- The Librarian is required to maintain full compliance with the General Data Protection Regulation (GDPR / DSGVO) and the Bavarian Data Protection Act (BayDSG) in all handling of patron records, digital collections, and institutional data while operating in Germany Munich.
- This Purchase Order may be terminated by either party with a written notice period of three (3) months, in accordance with § 621 BGB. In the event of early termination, all prepaid services and materials shall be settled pro-rata within fourteen (14) days.
- The Librarian shall be entitled to a minimum of twenty-five (25) working days of annual paid leave, in addition to public holidays observed in the state of Bavaria, as stipulated by the Bavarian Leave Act (BavUrlG).
- All intellectual property, cataloguing records, and institutional knowledge developed by the Librarian during the term of this Purchase Order shall remain the exclusive property of the Stadtbibliothek München and the city of Germany Munich.
- Any disputes arising from this Purchase Order shall be resolved through the competent labour court (Arbeitsgericht) in Munich, Germany. The parties agree to attempt mediation before initiating formal legal proceedings.
- This Purchase Order is valid for a period of twelve (12) months from the date of commencement and may be renewed by mutual written agreement of both parties no later than sixty (60) days prior to the expiration date.
