The Marine Engineer engaged under this Purchase Order shall perform the following duties in and around Afghanistan Kabul:
- Conduct a comprehensive condition assessment of all marine and riverine mechanical systems, including diesel generators, hydraulic winches, ballast pumps, and navigation equipment, within the first thirty (30) days of deployment to the Afghanistan Kabul site.
- Develop and implement a 12-month preventive maintenance schedule tailored to the specific environmental conditions of Afghanistan Kabul, including dust mitigation protocols for air-intake systems and thermal management for equipment operating in extreme seasonal temperature variations.
- Supervise all major repair and overhaul activities, ensuring compliance with International Maritime Organization (IMO) standards and applicable Afghan industrial safety regulations.
- Provide weekly written progress reports to the HRILC Director of Procurement detailing the status of all marine systems, outstanding work orders, and any safety concerns identified at the Afghanistan Kabul facility.
- Maintain a complete technical logbook for each piece of marine equipment, recording all inspections, repairs, parts replacements, and operational hours.
- Coordinate with local Afghan authorities regarding any permits, environmental clearances, or waterway usage authorizations required for marine engineering activities in Afghanistan Kabul.
- Deliver the 40-hour technical training program to a minimum of twelve (12) HRILC local staff members, ensuring competency in basic marine equipment operation and first-line maintenance.
The Marine Engineer shall report to the HRILC riverine terminal facility located in Darulaman District, Afghanistan Kabul, no later than 1 August 2025. The Seller (GMESL) is responsible for arranging international travel, visa processing in coordination with Afghan immigration authorities, and initial accommodation for the Marine Engineer in Afghanistan Kabul. The Buyer (HRILC) shall provide on-site workspace, secure access to all marine equipment areas, and necessary personal protective equipment (PPE) compliant with international marine engineering safety standards.
All marine-grade spare parts and specialized tools required for the scope of work shall be shipped to Afghanistan Kabul via the Seller's designated logistics partner. The Buyer shall facilitate customs clearance at Kabul International Airport (KBL) and provide secure warehousing for incoming marine components.
- Payment Schedule: 30% advance payment upon execution of this Purchase Order; 40% upon completion of the initial condition assessment and commissioning phase; 30% upon successful completion of the 12-month contract term.
- Payment Method: Wire transfer to the Seller's designated bank account in GBP or USD.
- Payment Terms: Net 30 days from receipt of a valid invoice and supporting documentation.
- Currency: All amounts are stated in United States Dollars (USD). Any applicable Afghan tax or duty shall be borne by the Buyer.
- Retainage: A retainage of 5% of the total contract value shall be held until final acceptance of all deliverables by the Buyer's technical team in Afghanistan Kabul.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the commercial laws of the Islamic Republic of Afghanistan, with supplementary reference to the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- Dispute Resolution: Any dispute arising from this Purchase Order shall first be subject to good-faith negotiation. If unresolved within thirty (30) days, the matter shall be referred to arbitration under the rules of the International Chamber of Commerce (ICC), with the seat of arbitration in Kabul, Afghanistan.
- Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to armed conflict, civil unrest, government sanctions, or natural disasters affecting Afghanistan Kabul.
- Insurance: The Seller shall maintain comprehensive professional indemnity insurance and marine engineering liability coverage for a minimum of USD 2,000,000 for the duration of the contract, valid in Afghanistan Kabul.
- Confidentiality: All technical drawings, operational data, and proprietary information related to the marine systems in Afghanistan Kabul shall be treated as strictly confidential by both parties.
- Termination: Either party may terminate this Purchase Order with sixty (60) days written notice. In the event of material breach, termination may be effected with fourteen (14) days notice.
- Compliance: The Marine Engineer shall comply with all applicable Afghan labor laws, health and safety regulations, and environmental protection statutes in force in Afghanistan Kabul at the time of performance.
