- This Purchase Order constitutes a binding agreement between Pacific Crest Digital Solutions Ltd and Apex Talent Partners (NZ) Ltd for the procurement of a Marketing Manager position and associated services as described herein. All terms are governed by the laws of New Zealand, specifically the Employment Relations Act 2000 and the Consumer Guarantees Act 1993.
- Payment terms: Net 30 days from the date of invoice. Payment shall be made via electronic funds transfer (EFT) to the supplier's nominated New Zealand bank account. All amounts are quoted in New Zealand Dollars (NZD) inclusive of applicable Goods and Services Tax (GST) at the current rate of 15%.
- The Marketing Manager shall commence employment no later than 1 August 2025 at the Pacific Crest Digital Solutions Ltd office located in Auckland CBD, New Zealand Auckland. The supplier is responsible for confirming the candidate's right to work in New Zealand, including verification of visa status or citizenship, prior to the commencement date.
- The appointed Marketing Manager must hold a minimum of seven (7) years of progressive marketing experience, with at least three (3) years in a senior or managerial capacity within the New Zealand or broader Australasian market. Demonstrable experience in digital marketing, brand strategy, and team leadership is a mandatory requirement.
- Apex Talent Partners (NZ) Ltd warrants that the Marketing Manager placed under this Purchase Order shall not be subject to any non-compete or restrictive covenant that would prevent them from performing their duties for Pacific Crest Digital Solutions Ltd in the New Zealand Auckland region.
- All personal information collected during the recruitment and onboarding process shall be handled in strict compliance with the Privacy Act 2020 (New Zealand). The supplier shall maintain all candidate records for a minimum of three (3) years in accordance with New Zealand employment record-keeping obligations.
- This Purchase Order may be amended only by written agreement signed by authorised representatives of both parties. Any variation to the scope, timeline, or cost of the Marketing Manager engagement must be documented in a formal change order prior to implementation.
- In the event of a dispute arising from this Purchase Order, both parties agree to first attempt resolution through good-faith mediation in Auckland, New Zealand, before pursuing any formal legal proceedings in the District Court of Auckland.
