- Delivery and Commencement: The Mason contractor shall mobilize all personnel and materials to the project site in El Biar, Algiers, Algeria within five (5) business days of the acceptance of this Purchase Order. Work shall commence no later than 22 June 2025.
- Completion Deadline: All masonry works described in this Purchase Order shall be completed within ninety (90) calendar days from the commencement date, subject to weather conditions and any approved change orders.
- Payment Terms: Payment shall be made in three (3) installments: 30% upon commencement and material delivery to site; 40% upon completion of structural masonry (Items 01 and 03); and 30% upon final acceptance and handover. All payments shall be made via bank transfer to the supplier's account at BNA (Banque Nationale d'Algérie), Algiers branch.
- Quality Standards: All masonry work shall conform to Algerian standard NPA 4.1.1 (Masonry Construction) and the seismic design requirements of RPA 99/2003. The Mason shall provide material certificates for all blocks, cement, and stone used.
- Warranty: The Mason contractor provides a structural warranty of five (5) years and a finishing warranty of two (2) years from the date of final acceptance, covering any defects in masonry workmanship or materials.
- Health, Safety, and Compliance: The Mason shall comply with all Algerian labor laws, OHS regulations, and Algiers municipal permits. All workers must wear appropriate PPE. The contractor is solely responsible for the safety of its personnel on site.
- Change Orders: Any modification to the scope of masonry work must be documented in a written change order signed by both parties before execution. Pricing for additional work shall be agreed upon in writing.
- Dispute Resolution: Any dispute arising from this Purchase Order shall be resolved through amicable negotiation. Failing resolution within thirty (30) days, the matter shall be submitted to the competent commercial court in Algiers, Algeria.
- Governing Law: This Purchase Order is governed by the laws of the People's Democratic Republic of Algeria, including the Algerian Commercial Code and applicable construction regulations.
- Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to natural disasters, government-mandated work stoppages, or supply chain disruptions specific to the Algeria Algiers region.
By signing below, both parties acknowledge and agree to all terms, conditions, and specifications set forth in this Purchase Order for the Mason services and materials to be delivered and executed in Algeria Algiers. This document constitutes a binding agreement upon countersignature.
