This Purchase Order is issued by Nile Construction & Development Co., Ltd. to Al-Masri Mason & Stoneworks Trading Co. for the supply of masonry materials and the execution of all mason work required for the Residential Tower Complex – Phase II, located in Egypt Cairo. - This Purchase Order is governed by the laws of the Arab Republic of Egypt and shall be interpreted in accordance with Egyptian commercial and construction regulations applicable in Egypt Cairo.
- The mason contractor shall mobilise all personnel, materials, and equipment to the project site in Egypt Cairo no later than 20 June 2025. Failure to mobilise within this window shall incur a penalty of EGP 15,000 per calendar day.
- All masonry work must comply with the Egyptian Building Code (EBC 2021), the specifications outlined in the project drawings (Rev. C, dated 01 May 2025), and the quality standards set by the Ministry of Housing and Urban Development for Egypt Cairo projects.
- Payment shall be made in three equal instalments (33.33% each) upon certified progress milestones: (a) completion of floors 1–4 masonry, (b) completion of floors 5–8 masonry, and (c) completion of floors 9–12 masonry plus all finishing works. Each payment is due within 30 days of the project engineer's certification.
- The mason contractor shall maintain valid third-party liability insurance and workers' compensation coverage for all mason labourers throughout the duration of this Purchase Order, with minimum coverage of EGP 10,000,000.
- All materials supplied under this Purchase Order must be sourced from approved Egyptian manufacturers. Substitution of any material requires prior written approval from the project architect and structural engineer.
- The mason contractor is responsible for all waste disposal, site housekeeping, and compliance with Egypt Cairo municipal environmental regulations. Debris and off-cuts must be removed from the site daily.
- A retention sum of 5% (EGP 322,278.00) shall be withheld from the final payment and released 12 months after practical completion, subject to a satisfactory defect-liability inspection.
- Any variation or change order to the masonry scope must be documented in a written amendment to this Purchase Order, signed by both parties, before additional work commences.
- Disputes arising from this Purchase Order shall be resolved through arbitration in Egypt Cairo in accordance with the rules of the Egyptian Arbitration Centre, and the language of arbitration shall be English.
