- This Purchase Order is issued by Shree Ganesh Construction & Infrastructure Pvt. Ltd. to the above-named Mason contractor for the execution of masonry and brickwork at the Skyline Residency Tower project site located in India Mumbai, Bandra West, Maharashtra.
- The Mason contractor shall mobilize all skilled and unskilled labour, tools, and equipment to the India Mumbai site within 7 (seven) calendar days from the date of acceptance of this Purchase Order.
- All masonry work shall be executed in strict compliance with the Bureau of Indian Standards (BIS), the Mumbai Municipal Corporation (MMC) building bylaws, and the structural drawings approved by the project architect.
- The Mason contractor is responsible for ensuring that all bricks, cement, sand, and mortar materials used in India Mumbai meet the quality specifications outlined in the project technical documents. Substandard materials will be rejected at the contractor's cost.
- Payment shall be made in monthly progress instalments based on certified work completion reports submitted by the site engineer. Payment terms: 70% on completion of each monthly cycle, 25% on final handover, and 5% retention released after the 12-month defect liability period.
- The Mason contractor shall comply with all labour laws applicable in India Mumbai, including the Maharashtra Shops and Establishments Act, the Building and Other Construction Workers Act, 1996, and the Payment of Wages Act. Proof of compliance must be submitted with each invoice.
- Any variation in scope of masonry work beyond 10% of the original Purchase Order value shall require a written amendment signed by both parties before execution.
- The Mason contractor shall maintain adequate insurance coverage, including workmen's compensation insurance and third-party liability insurance, for the duration of the project in India Mumbai.
- Disputes arising from this Purchase Order shall be resolved through arbitration in India Mumbai in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, Maharashtra.
- This Purchase Order is governed by the laws of India. The jurisdiction of courts in India Mumbai shall be exclusive for any legal proceedings.
- The Mason contractor shall ensure that all masonry work is completed within the stipulated project timeline of 14 months from the date of site handover. Delays attributable to the contractor shall attract a penalty of 0.5% of the delayed work value per day, up to a maximum of 10%.
- All invoices submitted under this Purchase Order must include a valid GST invoice as per the GST Act, 2017, and must reference the Purchase Order number SGC/PO/2025/0047.
