- This Purchase Order constitutes a binding agreement between Al-Nakheel Construction & Development W.L.L. and Al-Rasheed Mason & Stoneworks Co. upon written acceptance by both parties. All work and materials shall be delivered and executed at the project site located in Kuwait Kuwait City as specified herein.
- The Mason crew shall adhere to all safety protocols mandated by the Kuwait Ministry of Public Works and the Kuwait Municipality. Each mason on site must hold a valid trade license and personal protective equipment (PPE) as per local regulations.
- All masonry materials must be delivered to the site in Kuwait Kuwait City no later than the required delivery date stated above. Late delivery shall incur a penalty of 0.5% of the total Purchase Order value per calendar day of delay, capped at 10%.
- The mason workmanship must meet the specifications outlined in the project drawings (Ref: DWG-MS-2025-001 through DWG-MS-2025-042). Any deviation from the approved masonry layout or stone pattern must be pre-approved in writing by the project supervisor.
- Payment shall be processed via bank transfer to the vendor's designated account in Kuwait Kuwait City within 14 business days of invoice submission and acceptance of the corresponding milestone. The advance payment of 30% is due within 5 business days of this Purchase Order's acceptance.
- The vendor warrants that all mason-supplied materials are new, free from defects, and compliant with Kuwait Standards Institution (KSI) specifications. A 24-month warranty applies to all masonry work and stone cladding from the date of final acceptance.
- Force majeure events, including but not limited to extreme weather conditions typical of the Kuwait Kuwait City summer season (temperatures exceeding 50°C), may result in a mutually agreed extension of the delivery and completion schedule. The vendor must notify the buyer in writing within 48 hours of such an event.
- Disputes arising from this Purchase Order shall be resolved through arbitration in Kuwait Kuwait City in accordance with the Kuwait Arbitration Law (Law No. 11 of 2001). The governing law of this agreement is the law of the State of Kuwait.
- The vendor shall maintain adequate insurance coverage, including workers' compensation and third-party liability, for all mason personnel operating on the site in Kuwait Kuwait City throughout the duration of the contract.
- This Purchase Order may not be assigned or subcontracted without prior written consent from the buyer. Any approved subcontracting of mason labor must still comply with all terms stated in this document.
