This Purchase Order is issued by Kuala Lumpur Development Holdings Sdn. Bhd. and is binding upon acceptance by Mason Construction & Masonry Services Sdn. Bhd. All masonry works described herein shall be executed in strict accordance with the approved architectural and structural drawings for the KL Central Commercial Tower project located in Malaysia Kuala Lumpur.
Mason shall provide all labour, tools, equipment, scaffolding, and safety apparatus necessary to complete the masonry works. Mason shall ensure that all workers are properly trained, certified, and compliant with the Occupational Safety and Health Act 1994 (OSHA) as enforced in Malaysia Kuala Lumpur.
All materials supplied under this Purchase Order must meet or exceed the specifications outlined in the Malaysian Standard (MS) documents referenced in the line items. Mason shall provide material test certificates and mill test reports prior to installation.
Payment shall be made in monthly progress instalments based on certified quantities of Mason masonry work completed and accepted by the project architect and quantity surveyor. The final payment, including the 5% retention sum, shall be released within 14 days of the Certificate of Practical Completion.
Mason shall maintain a minimum of 20 qualified masons and 8 apprentices on site at all times during active masonry operations. Any reduction in workforce must be approved in writing by the buyer at least 7 days in advance.
Any variations or additional masonry works beyond the scope of this Purchase Order must be approved in writing by the buyer before execution. Mason shall submit a detailed variation order with cost implications for approval.
Mason shall provide a 24-month defect liability period from the date of Practical Completion for all masonry works. Any defects in Mason's masonry workmanship or materials discovered during this period shall be rectified at Mason's own cost within 14 days of written notice.
This Purchase Order is governed by the laws of Malaysia. Any disputes arising from this Purchase Order shall be resolved through arbitration in Malaysia Kuala Lumpur in accordance with the rules of the Asian International Arbitration Centre (AIAC).
Mason shall maintain comprehensive public liability insurance of not less than MYR 5,000,000 and workers' compensation insurance for the duration of the project. Certificates of insurance shall be provided to the buyer prior to commencement of works.
All masonry works must comply with the Building and Property Development Act 1966, the Uniform Building By-Laws 1984, and all applicable local authority regulations in Malaysia Kuala Lumpur. Mason shall obtain all necessary permits and notifications from the Kuala Lumpur City Hall (DBKL) prior to commencing works.
