This Purchase Order is issued by Dakar Infrastructure Development Corporation (hereinafter referred to as "the Buyer") to Atlantic Mason Products International Ltd. (hereinafter referred to as "the Supplier") for the procurement, manufacturing, packaging, and delivery of mason construction materials to be used in the Mason Block Housing Development Project, Phase III, located in the Almadies District of Senegal Dakar, Republic of Senegal. This Purchase Order governs all terms, conditions, specifications, and obligations related to the supply of mason units, mason mortar, and associated mason construction accessories required for the construction of 240 residential mason block units in Senegal Dakar.
The Buyer requires the Supplier to deliver all mason materials in full compliance with the technical specifications outlined in Annex A of this Purchase Order, as well as in accordance with the building codes and mason construction standards recognized by the Senegalese Ministry of Urban Planning and Housing. All mason products must be suitable for the tropical coastal climate conditions prevalent in Senegal Dakar, including high humidity, salt air exposure, and intense solar radiation.

The Supplier shall deliver all mason materials listed in this Purchase Order to the designated construction site in the Almadies District, Senegal Dakar, no later than 28 September 2025. Delivery shall be made in accordance with the Incoterms 2020 CIF (Cost, Insurance, and Freight) Port of Dakar, Senegal. The Supplier is responsible for all mason material packaging, loading, ocean freight, marine insurance, and unloading at the Port of Dakar. The Buyer shall arrange for inland transport from the Port of Dakar to the final construction site within Senegal Dakar.
All mason blocks and mason units must be palletized, shrink-wrapped, and clearly labeled with the Purchase Order number, item description, quantity, and the destination "Senegal Dakar – Almadies Construction Site." The Supplier must provide a detailed packing list and bill of lading at least 72 hours prior to vessel departure.
Upon arrival at the Senegal Dakar construction site, the Buyer's designated quality control engineer shall inspect a minimum of 10% of all mason blocks and mason units for dimensional accuracy, compressive strength, surface integrity, and compliance with the specifications stated in this Purchase Order. Any mason materials found to be defective, damaged in transit, or non-conforming to the agreed specifications shall be rejected at the Supplier's sole cost. The Supplier shall replace rejected mason materials within 30 calendar days of written notice from the Buyer.
- 5.1 – This Purchase Order constitutes a binding agreement between the Buyer and the Supplier upon signature by both parties. Any amendments to this Purchase Order must be made in writing and signed by authorized representatives of both parties.
- 5.2 – The Supplier warrants that all mason products supplied under this Purchase Order are new, of first quality, and free from any manufacturing defects. The warranty period for mason blocks and mason units is 12 months from the date of delivery at Senegal Dakar.
- 5.3 – Late delivery of mason materials beyond the agreed delivery date shall incur a penalty of 0.5% of the total Purchase Order value per calendar day of delay, up to a maximum of 10% of the total value.
- 5.4 – All disputes arising from this Purchase Order shall be resolved through arbitration in Dakar, Senegal, in accordance with the rules of the Senegalese Chamber of Commerce. The governing law shall be the laws of the Republic of Senegal.
- 5.5 – The Supplier shall comply with all applicable environmental regulations in Senegal Dakar regarding the transport, storage, and handling of mason construction materials. No hazardous substances shall be present in any mason product delivered under this Purchase Order.
- 5.6 – The Buyer reserves the right to conduct unannounced factory inspections at the Supplier's manufacturing facility prior to the dispatch of mason materials to Senegal Dakar.
- 5.7 – Force majeure events, including but not limited to natural disasters, port strikes in Senegal Dakar, or government-imposed trade restrictions, shall relieve the affected party from its obligations under this Purchase Order for the duration of the event, provided written notice is given within 5 business days.
This Purchase Order is hereby authorized and approved by the undersigned representatives of both parties. By signing below, each party acknowledges and agrees to all terms, conditions, specifications, and obligations set forth in this Purchase Order for the supply of mason construction materials to the Senegal Dakar project site.
