This Purchase Order constitutes a binding agreement between Nile Construction & Development Co., Ltd. (hereinafter "the Purchaser") and Al-Khatib Mason & Stoneworks Contracting LLC (hereinafter "the Mason Contractor") for the execution of all masonry works at the project site in Sudan Khartoum.
The Mason Contractor shall mobilise all personnel, tools, scaffolding, and materials to the site in Al-Murra District, Sudan Khartoum, no later than 20 June 2025. Failure to mobilise within this timeframe shall entitle the Purchaser to a penalty of 0.5% of the total Purchase Order value per day of delay.
All masonry work shall comply with the Sudanese National Building Code (SNBC 2022), the specifications outlined in the approved structural drawings, and the quality standards set by the Sudan Ministry of Housing and Urban Planning for projects located in Sudan Khartoum.
The Mason Contractor shall provide a minimum crew of twelve (12) skilled masons, four (4) helpers, and one (1) licensed Mason foreman on site during all working days (Sunday through Thursday, 7:00 AM to 5:00 PM, with a one-hour break for midday prayer).
Payment shall be made in three (3) progress instalments: 30% upon completion of foundation and ground-floor blockwork, 40% upon completion of all structural masonry up to the roof level, and 30% upon final completion and acceptance of all plastering and finishing works. Each instalment is due within thirty (30) calendar days of the Purchaser's written approval of the respective milestone.
The Mason Contractor shall bear full responsibility for the safety of all workers on site in accordance with the Occupational Health and Safety regulations of the Republic of Sudan. All workers must wear appropriate personal protective equipment (PPE) at all times while performing masonry tasks in Sudan Khartoum.
All materials including bricks, blocks, cement, sand, and reinforcement steel shall be sourced from approved suppliers registered with the Sudan Chamber of Commerce in Khartoum. The Mason Contractor shall submit material test certificates for cement and structural blocks prior to use on site.
The Purchaser reserves the right to inspect and audit all masonry work at any stage. Any work found to be non-compliant with the specifications of this Purchase Order shall be rectified by the Mason Contractor at no additional cost to the Purchaser.
Disputes arising from this Purchase Order shall be resolved through amicable negotiation. Should negotiation fail, the matter shall be referred to the Arbitration Centre of the Khartoum Chamber of Commerce in Sudan Khartoum in accordance with its rules of procedure.
This Purchase Order is governed by the laws of the Republic of Sudan. All notices and correspondence related to this order shall be sent to the addresses stated above in Sudan Khartoum.

By signing below, both parties acknowledge and agree to all terms, conditions, and specifications set forth in this Purchase Order for the Mason works to be executed in Sudan Khartoum. This document is valid for a period of ninety (90) days from the date of issue, after which a revised Purchase Order must be issued to reflect any changes in scope, pricing, or timeline.
