- Scope of Mechanic Work: The Mechanic, Southern Cross Automotive Mechanic Services, shall perform all work described in this Purchase Order in strict compliance with Australian Standards (AS), New South Wales heavy vehicle regulations, and all applicable Australia Sydney local council by-laws governing vehicle maintenance and repair operations.
- Qualifications: The lead Mechanic assigned to this Purchase Order must hold a valid NSW Heavy Vehicle Licence (Class HC) and a minimum of five (5) years of documented experience in commercial diesel vehicle repair within the Australia Sydney metropolitan region. All assisting Mechanic staff must hold appropriate trade qualifications recognised by the Australian Skills Quality Authority.
- Parts and Materials: All replacement parts and materials used by the Mechanic must be genuine OEM or approved equivalent components. The Mechanic shall provide itemised receipts for all parts purchased under this Purchase Order. No aftermarket or unapproved parts shall be installed without prior written consent from the Purchasing Entity.
- Warranty: The Mechanic shall provide a minimum twelve (12) month or 20,000 kilometre warranty (whichever expires first) on all labour and parts installed under this Purchase Order. This warranty is in addition to any manufacturer warranties and is valid throughout Australia Sydney and the broader New South Wales region.
- Payment Terms: Payment of the total amount of AUD $21,301.50 shall be made within thirty (30) days of receipt of a valid tax invoice from the Mechanic. Payment shall be made via electronic funds transfer (EFT) to the bank account nominated by Southern Cross Automotive Mechanic Services. Late payments shall attract interest at the rate prescribed under the Australian Consumer Law.
- Completion and Handover: All Mechanic work under this Purchase Order must be completed and the vehicle made available for collection at the Mechanic's premises located in Ultimo, Australia Sydney, no later than 28 June 2025. The Mechanic shall provide a completed work order, diagnostic reports, and all relevant compliance certificates at the time of handover.
- Insurance and Liability: The Mechanic shall maintain comprehensive public liability insurance of no less than AUD $20,000,000 and professional indemnity insurance of no less than AUD $5,000,000 for the duration of this Purchase Order. The Mechanic assumes full liability for any damage to the vehicle or third-party property arising from the performance of work under this Purchase Order within Australia Sydney.
- Compliance with Australian Law: This Purchase Order and all Mechanic services rendered hereunder shall comply with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), the NSW Road Transport Act 2013, and all regulations administered by Transport for NSW in Australia Sydney.
- Dispute Resolution: Any dispute arising from this Purchase Order relating to Mechanic services in Australia Sydney shall first be subject to mediation under the NSW Civil and Administrative Tribunal (NCAT) procedures. If unresolved, the matter shall be referred to the courts of New South Wales, Australia Sydney.
