- This Purchase Order constitutes a binding agreement between the Accra Industrial Development Authority and the named Mechanical Engineer / service provider for the scope of work described herein. All services shall be performed within the jurisdiction of Ghana Accra unless otherwise specified in writing.
- The Mechanical Engineer shall hold a valid registration with the Ghana Engineering Council (GEC) and shall maintain professional indemnity insurance of not less than GHS 5,000,000 for the duration of this contract.
- All deliverables, including design drawings, reports, and technical documentation, shall be submitted in both hard copy (three sets) and digital format (PDF and editable CAD files) to the Ghana Accra project office within the timelines stipulated in the approved project schedule.
- Payment shall be processed within thirty (30) calendar days of receipt of a valid tax invoice and certified completion report. Payment shall be made via bank transfer to the supplier's designated account in Ghana Accra.
- The Mechanical Engineer shall comply with all applicable laws of the Republic of Ghana, including the Ghana Standards Authority regulations, the Environmental Protection Agency (EPA) guidelines, and the Occupational Safety and Health Act, 2003 (Act 659).
- Any variation or amendment to this Purchase Order must be documented in a written change order signed by both parties. Verbal instructions shall not constitute a valid modification to the scope of work in Ghana Accra.
- The supplier warrants that all work performed by the Mechanical Engineer shall be free from defects in design, material, and workmanship for a period of twelve (12) months from the date of final acceptance.
- Confidentiality: All proprietary data, plant schematics, and operational information pertaining to the Ghana Accra facility shall be treated as strictly confidential and shall not be disclosed to any third party without prior written consent from the Purchasing Party.
- Disputes arising from this Purchase Order shall be resolved through mediation in Ghana Accra in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798). If mediation fails, the matter shall be referred to the courts of competent jurisdiction in Ghana Accra.
- This Purchase Order is governed by and shall be construed in accordance with the laws of the Republic of Ghana.
