Bhd. for the professional services of a qualified Mechanical Engineer to be deployed at the Malaysia Kuala Lumpur manufacturing facility located at Lot 45, Jalan Industri 7, Taman Perindustrian UEP, 47600 Subang Jaya, Selangor, Malaysia. The Mechanical Engineer shall provide comprehensive design, analysis, and technical oversight services in accordance with the scope detailed below.

The Mechanical Engineer engaged under this Purchase Order shall perform the following duties at the Malaysia Kuala Lumpur facility and, where required, at the supplier's office in Malaysia Kuala Lumpur:

  • Conduct a full thermal and hydraulic analysis of the existing HVAC system and produce a detailed retrofit design package compliant with the Malaysian Building Code (MS 1525) and local by-laws of the Kuala Lumpur City Hall (DBKL).
  • Perform structural and pressure vessel inspections in accordance with the Malaysian Boiler and Pressure Vessel Regulations 1997 and issue a condition report with recommended remedial actions.
  • Develop a 12-month predictive maintenance schedule for all rotating mechanical equipment, incorporating vibration analysis, oil analysis, and thermographic inspection protocols.
  • Provide daily on-site technical supervision during the installation and commissioning period, ensuring all work complies with OSHA 1994, Factories and Machinery Act 1967, and relevant Malaysian Standards (MS).
  • Deliver a complete set of As-Built drawings, O&M manuals, and a final technical report to the project manager at Kuala Lumpur Industrial Solutions Sdn. Bhd. within 14 calendar days of project completion.

The Mechanical Engineer shall commence services no later than 1 July 2025. The overall project duration is estimated at 120 calendar days, with a target completion date of 28 October 2025. Any extension of time must be approved in writing by the project manager prior to the original completion date. All work shall be performed during standard business hours (Monday to Friday, 8:00 AM to 6:00 PM) at the Malaysia Kuala Lumpur site unless otherwise agreed in writing.

  • Payment shall be made within thirty (30) calendar days from the date of receipt of a valid tax invoice issued by the supplier.
  • Payment shall be made via bank transfer to the supplier's designated account in Malaysian Ringgit (MYR).
  • A 10% retention sum shall be withheld from each progress payment and released in full upon satisfactory completion and acceptance of all deliverables.
  • All amounts stated in this Purchase Order are in Malaysian Ringgit (MYR) and are inclusive of all applicable Malaysian Sales and Service Tax (SST) at the prevailing rate of 6%.
  • The supplier shall bear all costs associated with obtaining any necessary permits, licences, or approvals from Malaysian authorities (including but not limited to DOSH, DBKL, and local municipal councils) required to carry out the work under this Purchase Order.
  • This Purchase Order is governed by the laws of Malaysia. Any disputes arising from or in connection with this Purchase Order shall be subject to the exclusive jurisdiction of the courts of Malaysia Kuala Lumpur.
  • The Mechanical Engineer shall maintain valid professional indemnity insurance with a minimum coverage of MYR 2,000,000 and workers' compensation insurance as required under the Employees' Provident Fund (EPF) and Employees' Insurance Scheme (EIS) regulations in Malaysia.
  • The supplier shall ensure that the Mechanical Engineer holds a valid registration with the Board of Engineers Malaysia (BEM) and is a member in good standing of the Institution of Engineers, Malaysia (IEM).
  • Confidentiality: All technical data, drawings, and proprietary information exchanged under this Purchase Order shall be treated as confidential and shall not be disclosed to third parties without prior written consent of Kuala Lumpur Industrial Solutions Sdn. Bhd.
  • Termination: Either party may terminate this Purchase Order with thirty (30) days' written notice. In the event of termination, the supplier shall be compensated for all work satisfactorily completed up to the date of termination.
  • Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to events beyond reasonable control, including but not limited to natural disasters, government actions, or public health emergencies affecting Malaysia Kuala Lumpur.

This Purchase Order becomes effective upon signature by both parties. The supplier's acceptance of this Purchase Order constitutes full agreement to all terms, conditions, scope of work, and pricing as set forth herein.
