All goods covered by this Purchase Order shall be delivered to the Kabul University Medical Sciences campus, Darulaman District, Afghanistan Kabul, no later than 30 September 2025. The supplier is responsible for arranging air freight via Hamid Karzai International Airport (KBL) and coordinating with the Afghanistan Kabul customs authority for the clearance of medical and laboratory equipment. Installation, calibration, and a 48-hour operational test of the BSL-2 Mobile Laboratory Unit and the portable PCR systems shall be completed on-site in Afghanistan Kabul within five (5) business days of delivery. The Medical Researcher, Dr. Ahmadzai, or her designated laboratory supervisor, must sign the delivery and acceptance certificate before the Purchase Order is considered fulfilled.
Payment shall be made in United States Dollars (USD) via irrevocable letter of credit issued by the Central Bank of Afghanistan, Kabul branch. The payment schedule is as follows: 40% (USD 97,806.00) upon issuance of this Purchase Order; 40% (USD 97,806.00) upon confirmed shipment and presentation of the bill of lading; and 20% (USD 48,903.00) upon successful installation, calibration, and acceptance in Afghanistan Kabul. Late payments shall incur a penalty of 1.5% per calendar week.
- This Purchase Order is governed by the laws of the Islamic Republic of Afghanistan and, where applicable, the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- The supplier warrants that all equipment is new, unused, and compliant with WHO and CDC standards for medical research in conflict-affected regions such as Afghanistan Kabul.
- The Medical Researcher's data collected using the procured equipment shall remain the intellectual property of the Ministry of Public Health, Afghanistan Kabul. The supplier shall not access, replicate, or distribute any research data.
- In the event of force majeure, including but not limited to security disruptions in Afghanistan Kabul, either party may suspend performance with written notice within 72 hours.
- All disputes arising from this Purchase Order shall be resolved through arbitration in Geneva, Switzerland, under the rules of the ICC.
- The supplier shall provide a 24-month warranty on all capital equipment and a 12-month warranty on consumables, with on-site repair support in Afghanistan Kabul.
