All items specified in this Purchase Order must be delivered to the Brisbane Institute of Medical Sciences, Laboratory Wing C, 400 George Street, Brisbane, Queensland 4000, Australia Brisbane. The supplier is responsible for freight, insurance, and on-site installation of all capital equipment (Items 01, 02, 07, and 08). Installation must be completed and verified by the Medical Researcher's designated laboratory technician prior to the required delivery date. The supplier shall provide a written installation certificate and a 24-month warranty for all capital equipment. Consumables and reagents (Items 03 through 06 and 10) must be delivered in their original sealed packaging with unexpired shelf life of no less than 12 months from the date of delivery.
- 4.1 This Purchase Order is governed by the laws of the State of Queensland, Australia, and the Commonwealth of Australia. Any disputes arising from this Purchase Order shall be resolved in the courts of Australia Brisbane.
- 4.2 The supplier warrants that all goods supplied under this Purchase Order shall be new, unused, of merchantable quality, and fit for the purpose of medical research as specified by the Medical Researcher.
- 4.3 Payment shall be made by electronic funds transfer (EFT) to the supplier's nominated bank account within thirty (30) calendar days of receipt of a valid tax invoice, subject to satisfactory delivery and acceptance of all goods.
- 4.4 The Medical Researcher or her authorised delegate reserves the right to inspect all delivered goods upon arrival. Any goods found to be damaged, defective, or non-conforming to the specifications in this Purchase Order shall be rejected and replaced at the supplier's sole cost within ten (10) business days.
- 4.5 The supplier shall comply with all applicable Australian Standards (AS/NZS), the Australian Therapeutic Goods Administration (TGA) regulations where applicable, and the BIMS Occupational Health and Safety Policy.
- 4.6 This Purchase Order does not constitute a guarantee of research outcomes. The Medical Researcher assumes full scientific responsibility for the use of the procured materials in accordance with BIMS ethics approval (HREC Ref: 2025/0034).
- 4.7 The supplier shall not subcontract any portion of the delivery or installation without prior written consent from the BIMS Procurement Office, Australia Brisbane.
- 4.8 Late delivery beyond the required delivery date shall incur a penalty of 0.5% of the total Purchase Order value per calendar day, up to a maximum of 5%.
