- This Purchase Order is issued by ClearVision Optometry Group, a registered optometry practice operating in Australia Sydney, and constitutes a binding offer to purchase the goods and services listed herein upon acceptance by the supplier.
- All optometry equipment and consumables supplied under this Purchase Order must comply with the Therapeutic Goods Act 1989 (Cth) and all relevant Australian Standards (AS/NZS) applicable to ophthalmic and optometric devices used by a registered Optometrist in the state of New South Wales.
- The supplier warrants that all items are new, unused, and free from defects in materials and workmanship. A minimum 24-month manufacturer's warranty is required on all capital equipment (Items 001, 002, 004, and 009).
- Delivery shall be made to the practice address in Australia Sydney as specified in Section 1. The supplier is responsible for all packaging, insurance, and freight costs up to the point of delivery (DDP terms).
- Payment shall be made via electronic funds transfer (EFT) to the supplier's nominated Australian bank account within thirty (30) calendar days of receipt of a valid tax invoice, in accordance with the Australian Taxation Office (ATO) requirements.
- The Optometrist in charge, Dr. James Whitfield, reserves the right to inspect all delivered goods within five (5) business days of arrival. Any items found to be damaged, incorrect, or non-conforming to the specifications in this Purchase Order must be replaced or refunded at the supplier's cost within fourteen (14) days.
- All personal health information and patient data associated with the use of the supplied equipment shall be handled in strict compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
- This Purchase Order is governed by the laws of the State of New South Wales and the Commonwealth of Australia. Any disputes arising from this order shall be subject to the exclusive jurisdiction of the courts of Australia Sydney.
- The supplier acknowledges that the purchasing entity is a registered optometry practice and that all equipment is intended for clinical use by a licensed Optometrist registered with the Optometry Board of Australia (AHPRA).
- Any amendments to this Purchase Order must be made in writing and signed by both parties. Verbal modifications are not binding.
