1. Description of ProcurementThis Purchase Order is issued by Berliner Notdienst Koordinationszentrale GmbH for the procurement of certified Paramedic emergency medical services to be deployed and operated within the metropolitan area of Germany Berlin. The Paramedic personnel engaged under this Purchase Order shall provide advanced life support (ALS), basic life support (BLS), pre-hospital emergency care, and medical transport services in full compliance with the German Federal Medical Licensing Act (Bundesärzteordnung) and the regulations of the Berlin State Medical Association (Landesärztekammer Berlin). All Paramedic staff must hold a valid German Paramedic license (Notfallsanitäter) as recognized under the German Health Professions Act (Heilberufsgesetz) and must be registered with the competent authority in Germany Berlin.

- Scope of Paramedic Services: The Supplier shall provide qualified Paramedic personnel for all emergency medical response operations within the administrative boundaries of Germany Berlin, including but not limited to the districts of Mitte, Charlottenburg-Wilmersdorf, Pankow, Neukölln, and Tempelhof-Schöneberg. The Paramedic team must be available on a 24-hour, 365-day basis to ensure uninterrupted emergency coverage.
- Compliance with German Regulations: All Paramedic services rendered under this Purchase Order must strictly adhere to the German Civil Code (Bürgerliches Gesetzbuch), the German Social Code Book V (Sozialgesetzbuch V), and the specific emergency medical service regulations (Rettungsdienstverordnung) applicable in Germany Berlin. The Supplier warrants that every Paramedic deployed holds a current, valid Notfallsanitäter qualification and is insured under the German statutory health insurance framework.
- Service Level Agreement (SLA): The Supplier guarantees that a Paramedic unit shall arrive at any emergency call location within Germany Berlin within a maximum response time of 8 minutes for ALS calls and 12 minutes for BLS calls. Failure to meet these response times for more than 5% of total dispatches in any calendar month shall entitle the Buyer to a service credit of 2% of the monthly invoice value.
- Payment Terms: Invoices for Paramedic services rendered under this Purchase Order shall be submitted monthly, no later than the 5th business day of the following month. Payment shall be made via SEPA bank transfer within 30 days of receipt of a valid invoice. Late payments shall incur interest at the statutory rate under German law (BGB § 288).
- Confidentiality and Data Protection: All patient data collected by the Paramedic team during operations in Germany Berlin shall be processed in strict accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz). The Supplier shall implement appropriate technical and organizational measures to safeguard all medical records.
- Termination: Either party may terminate this Purchase Order with a written notice period of 90 days. In the event of material breach, including but not limited to the deployment of unlicensed Paramedic personnel or repeated SLA violations, the Buyer may terminate this Purchase Order immediately without penalty.
- Governing Law and Jurisdiction: This Purchase Order shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from or in connection with this Purchase Order shall be subject to the exclusive jurisdiction of the competent courts in Germany Berlin.
- Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to events beyond reasonable control, including but not limited to natural disasters, pandemics, or government-mandated restrictions affecting emergency medical services in Germany Berlin.
The Paramedic services described in this Purchase Order shall commence on 1 July 2025 and shall continue on a rolling 12-month contract basis unless terminated in accordance with Clause 3.6. All Paramedic personnel, vehicles, and medical equipment shall be stationed at the designated emergency response bases located throughout Germany Berlin as specified in the operational annex attached to this Purchase Order.
