3. SCOPE OF PHARMACIST RESPONSIBILITIES

The Pharmacist engaged under this Purchase Order shall perform the following duties within the Nepal Kathmandu facility:

  1. Verify all prescriptions issued by registered physicians before dispensing medication to patients, ensuring compliance with the Nepal Drug Act and regulations set forth by the Department of Drug Administration in Kathmandu.
  2. Prepare, compound, and dispense pharmaceutical preparations in accordance with the standards established by the Nepal Council of Pharmacy.
  3. Maintain accurate records of all pharmaceutical transactions, including controlled substances, as mandated by the Nepal Kathmandu municipal health authority.
  4. Conduct monthly inventory audits and submit written reports to the Chief Medical Officer regarding stock levels, expirations, and procurement recommendations.
  5. Provide patient counselling on medication usage, side effects, and storage instructions for all dispensed pharmaceutical products.
  6. Coordinate with the Kathmandu regional pharmaceutical suppliers to ensure uninterrupted supply of essential medicines and medical supplies.
  7. Participate in quarterly compliance inspections conducted by the Nepal Kathmandu health regulatory body and maintain all required licensing documentation.
  8. Deliver quarterly training sessions for junior pharmacy technicians and assistant pharmacists on best practices in pharmaceutical care.
4. TERMS AND CONDITIONS
  1. Payment Terms: Payment for the services outlined in this Purchase Order shall be made on a monthly basis within fifteen (15) calendar days of the end of each service month. Payment shall be processed via bank transfer to the account designated by the supplier. All amounts are denominated in Nepalese Rupees (NPR) and are subject to the applicable 13% Value Added Tax (VAT) as per Nepal tax law.
  2. Engagement Period: The Pharmacist services shall commence on 1 July 2025 and continue for a period of twelve (12) months, concluding on 30 June 2026, unless extended by mutual written agreement between both parties.
  3. Licensing and Qualifications: The Pharmacist must hold a valid registration with the Nepal Council of Pharmacy and a current practice license issued by the Department of Drug Administration, Nepal Kathmandu. The supplier shall provide copies of all relevant credentials prior to the commencement of services.
  4. Working Hours: The Pharmacist shall work a standard schedule of 48 hours per week, Monday through Saturday, from 9:00 AM to 5:30 PM, with a one-hour lunch break. Emergency on-call duties may be required on a rotational basis.
  5. Termination: Either party may terminate this Purchase Order by providing thirty (30) days written notice. In the event of gross professional misconduct or loss of pharmacy license, the purchasing party may terminate immediately without notice.
  6. Confidentiality: The Pharmacist shall maintain strict confidentiality regarding all patient records, proprietary formulary data, and business operations of the purchasing party in accordance with Nepal's data protection regulations.
  7. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Kingdom of Nepal. Any disputes arising from this document shall be resolved through arbitration in Kathmandu, Nepal, in accordance with the Nepal Arbitration Act.
  8. Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to natural disasters, government-imposed lockdowns, or other events beyond reasonable control, as commonly experienced in the Nepal Kathmandu region.
