The Plumber and their qualified team of certified technicians shall perform all work in accordance with the German DIN standards (DIN 1986, DIN 1988), the local Munich building regulations (Münchner Bauordnung), and all applicable federal and Bavarian state plumbing codes. The Plumber is expected to deliver professional, code-compliant workmanship and to maintain full liability insurance coverage throughout the duration of the contract.

All Plumber work described in this Purchase Order shall commence no later than 1 July 2025 and shall be completed by 30 September 2025, unless otherwise agreed in writing by both parties. The Plumber shall submit a detailed project timeline and weekly progress reports to the Bauwerk Facility Management project coordinator. Any delays caused by the Plumber beyond the agreed completion date shall be subject to a penalty of 0.5% of the total Purchase Order value per calendar day of delay, capped at 10% of the total value.

Payment for this Purchase Order shall be made in three instalments: 30% upon signing and confirmation of this Purchase Order, 50% upon completion of all installation work and successful pressure testing, and the remaining 20% upon final acceptance and handover of all documentation (including as-built drawings, warranty certificates, and gas safety reports). Payment shall be made via bank transfer to the account of HydroTech Plumber & Sanitary Solutions GmbH within 30 days of receipt of a valid invoice. Late payments shall accrue interest at the statutory rate under § 288 of the German Civil Code (BGB).

This Purchase Order is governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for any disputes arising from this Purchase Order shall be Munich, Germany.
The Plumber warrants that all materials supplied and all work performed shall be free from defects in design, material, and workmanship for a period of not less than five (5) years from the date of final acceptance.
The Plumber shall hold a valid Meisterbrief (master craftsman certificate) in the trade of Sanitär-Heizung-Klima (SHK) and shall ensure that all technicians assigned to the Germany Munich site are properly licensed and insured.
The Plumber shall comply with all applicable health and safety regulations, including the German Occupational Safety and Health Act (Arbeitsschutzgesetz) and the Bavarian Work Safety Ordinance (BayArbSchV).
All waste materials generated during the execution of this Purchase Order shall be disposed of in accordance with the German Circular Economy Act (Kreislaufwirtschaftsgesetz) and the local Munich waste management regulations.
The Plumber shall not subcontract any portion of the work without prior written consent from Bauwerk Facility Management GmbH.
This Purchase Order may only be amended or modified by a written addendum signed by both parties. Verbal agreements shall have no legal effect.
Force majeure events, as defined under § 275 BGB, shall relieve the affected party from performance obligations for the duration of the event, provided that written notice is given within 48 hours.
