- Compliance with Japan Kyoto Regulations: All plumbing work performed under this Purchase Order shall strictly comply with the Japan Building Standards Act, the Japan Kyoto City Plumbing Ordinance, and all applicable national and prefectural safety codes. The Plumber is responsible for obtaining all necessary permits and notifications from the Japan Kyoto municipal government prior to commencing any work.
- Plumber Qualifications: The designated Plumber and all subordinate technicians must possess valid Japanese plumbing trade licenses (Rikigai Shigyo Nushi) and current safety certifications. Proof of qualifications shall be submitted to the Buyer no later than five (5) business days before the service commencement date.
- Work Schedule and Access: All plumbing work shall be conducted between the hours of 08:00 and 17:00 Japan Standard Time (JST), Monday through Friday, unless otherwise approved in writing by the Buyer. The Plumber shall coordinate with Japan Kyoto facility management to minimize disruption to municipal operations.
- Materials and Standards: All plumbing materials, fittings, and equipment supplied by the Plumber must be new, of commercial grade, and certified for use in Japan. Materials must meet or exceed JIS (Japanese Industrial Standards) specifications. The Plumber shall provide material data sheets and certificates of conformity upon request.
- Warranty: The Plumber shall provide a minimum two-year warranty on all labor and workmanship, and a minimum five-year warranty on all installed equipment and materials, commencing from the date of final acceptance by the Buyer in Japan Kyoto.
- Insurance and Liability: The Plumber shall maintain comprehensive general liability insurance with a minimum coverage of 100,000,000 JPY and workers’ compensation insurance for all personnel. The Plumber assumes full liability for any damage to the Japan Kyoto facility, adjacent properties, or public infrastructure caused by the performance of plumbing work under this Purchase Order.
- Change Orders: Any modifications to the scope of work described in this Purchase Order must be documented in a written Change Order signed by both the Buyer and the Plumber. No additional charges shall be incurred without prior written authorization.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation in Japan Kyoto in accordance with the Japanese Arbitration Act. The courts of Kyoto-shi, Japan shall have exclusive jurisdiction.
- Confidentiality: The Plumber shall treat all information regarding the Japan Kyoto facility layout, security systems, and municipal operations as strictly confidential and shall not disclose such information to any third party without written consent.
- Termination: Either party may terminate this Purchase Order with thirty (30) days’ written notice. In the event of termination, the Plumber shall be compensated for all work completed and materials procured up to the termination date, subject to final inspection and approval by the Buyer.
This Purchase Order becomes effective upon signature by both parties. The Plumber acknowledges receipt of this Purchase Order and agrees to perform all services in accordance with the terms, specifications, and schedule outlined herein. The Buyer confirms that the funds allocated for this Purchase Order have been approved by the Japan Kyoto Municipal Budget Committee for the fiscal year 2025.
