The Plumber shall provide all labour, tools, and standard plumbing materials necessary to complete the scope of work described in the line items below. 1. Acceptance: This Purchase Order becomes a binding contract upon written acceptance by the Plumber, Al-Burj Plumbing & Maintenance Services Co. W.L.L., within five (5) business days of the date of issue. Failure to respond within this period shall be deemed a declination of this Purchase Order.
2. Performance Period: The Plumber shall mobilise to the project site in Kuwait Kuwait City no later than 16 June 2025 and shall complete all work described in Section 3 by 28 June 2025, unless otherwise agreed in writing by the Issuing Company.
3. Quality and Compliance: All plumbing work performed by the Plumber must conform to the Kuwait Building Code, ASME B31.3 (where applicable), and the specifications of the Kuwait Water Authority. All materials must carry the relevant Kuwait Standards and Metrology Organisation (KSMO) conformity mark.
4. Insurance: The Plumber shall maintain, at its own cost, a comprehensive general liability insurance policy with a minimum coverage of KWD 200,000 and a workers' compensation policy covering all personnel on site in Kuwait Kuwait City. Certificates of insurance shall be submitted prior to mobilisation.
5. Warranty: The Plumber provides a warranty of twelve (12) months from the date of final acceptance for all workmanship and a manufacturer's warranty (minimum two years) for all supplied equipment and materials. Any defects discovered during the warranty period shall be rectified by the Plumber at no additional cost within seven (7) calendar days of written notice.
6. Payment Terms: Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice from the Plumber, subject to satisfactory completion and sign-off by the Issuing Company's site supervisor. Payment shall be made by bank transfer to the account designated by the Plumber in Kuwait Kuwait City.
7. Site Access and Safety: The Plumber shall comply with all site safety rules, wear appropriate personal protective equipment (PPE), and obtain any necessary permits from the Kuwait Fire and Civil Defence Authority before commencing hot work (soldering, cutting, welding) at the project site in Kuwait Kuwait City.
8. Debris Removal: The Plumber shall remove all construction waste, old fixtures, and packaging materials from the site daily and dispose of them at licensed waste facilities in Kuwait in accordance with the Public Authority for Environment (PAE) regulations.
9. Dispute Resolution: Any dispute arising from this Purchase Order shall first be subject to amicable negotiation. If unresolved within fifteen (15) days, the matter shall be referred to arbitration in Kuwait Kuwait City in accordance with the Kuwait Arbitration Law (Law No. 11 of 1982). The language of arbitration shall be English.
10. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of Kuwait.
