TERMS AND CONDITIONS- 1. Scope of Work: This Purchase Order authorises the named Plumber to perform all plumbing services and supply all materials listed above at the specified service location in Valencia, Spain. The Plumber shall adhere to all applicable Spanish national regulations, including the Código Técnico de la Edificación (CTE), the Reglamento de Instalaciones en Edificios de Vivienda (RITBV), and the local bylaws of the Ayuntamiento de Valencia.
- 2. Schedule: All Plumber work shall commence no later than 23 June 2025 and shall be completed within fourteen (14) calendar days. Any delays attributable to the Plumber will incur a penalty of 0.5% of the total Purchase Order value per day of delay, up to a maximum of 10%.
- 3. Payment: Payment shall be made by direct bank transfer (SEPA) within thirty (30) calendar days of receipt of a valid invoice from the Plumber, provided that all work has been inspected and approved by the Requisitioner. The invoice must reference this Purchase Order number (PO-2025-04871) and include the Plumber's NIF.
- 4. Warranty: The Plumber guarantees all workmanship and materials for a minimum period of five (5) years from the date of final acceptance, in accordance with Article 1589 of the Spanish Civil Code and the applicable provisions of the TRLGDCU (Consumer Protection Act) as they pertain to professional services in Spain.
- 5. Insurance and Liability: The Plumber shall maintain valid professional liability insurance (seguro de responsabilidad civil profesional) with a minimum coverage of € 300,000 and workers' compensation insurance (seguro de accidentes de trabajo) for all personnel on site. Certificates of insurance must be presented prior to commencement of work.
- 6. Health and Safety: The Plumber shall comply with the Ley 31/1995 de Prevención de Riesgos Laborales and all site-specific safety protocols. A designated safety officer from the Plumber's team must be present at all times during active work in Valencia.
- 7. Governing Law and Jurisdiction: This Purchase Order shall be governed by the laws of Spain. Any disputes arising from this Purchase Order shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain, unless otherwise mandated by mandatory consumer protection legislation.
- 8. Amendments: No modification to this Purchase Order shall be valid unless issued in writing and signed by both parties. Any change in scope, materials, or schedule must be documented as a formal amendment to this Purchase Order.
