- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom. Any disputes arising from this Purchase Order relating to Plumber services in Birmingham shall be subject to the exclusive jurisdiction of the courts of Birmingham, United Kingdom.
- Payment Terms: Payment shall be made within 30 days of receipt of a valid tax invoice from the Plumber. A 50% deposit is due upon acceptance of this Purchase Order, with the remaining 50% payable upon satisfactory completion and sign-off of all Plumber works at the Birmingham site.
- Plumber Qualifications: The Plumber (Hartwell & Sons Plumbing Services) warrants that all personnel assigned to this Purchase Order shall be fully qualified, insured, and registered. The lead Plumber must hold a valid Gas Safe registration number and a Water Fitting Installer registration. Proof of public liability insurance (minimum £5,000,000) must be provided prior to commencement of works.
- Site Access and Hours: The Plumber shall access the site at The Meridian Business Centre, Birmingham, B2 4HA, United Kingdom, between the hours of 08:00 and 17:00, Monday to Friday. No works shall be carried out on public holidays as designated in the United Kingdom.
- Health and Safety: The Plumber shall comply with all requirements of the Health and Safety at Work etc. Act 1974, the Construction (Design and Management) Regulations 2015, and all Birmingham City Council site-specific safety protocols. A Risk Assessment and Method Statement (RAMS) must be submitted to the Purchaser at least 5 working days before commencement.
- Materials and Standards: All materials supplied by the Plumber under this Purchase Order must be new, of a quality suitable for commercial use in Birmingham, and compliant with BS EN standards. All pipework must be certified for use in the United Kingdom water supply network.
- Warranty: The Plumber provides a minimum 12-month warranty on all workmanship and a manufacturer's warranty (minimum 5 years) on all installed equipment. Any defects discovered within the warranty period shall be rectified by the Plumber at no additional cost to the Purchaser.
- Delays and Penalties: Should the Plumber fail to complete the works by the Required Completion Date stated in this Purchase Order, a penalty of 1.5% of the total Purchase Order value per calendar day of delay shall be deducted from the final invoice, up to a maximum of 15%.
- Change Orders: Any variation to the scope of Plumber works described in this Purchase Order must be agreed in writing by both parties prior to execution. No additional charges shall be incurred without a formally issued Change Order referencing this Purchase Order number.
- Confidentiality: The Plumber shall treat all information relating to the Purchaser's property in Birmingham, United Kingdom, as confidential and shall not disclose any details of this Purchase Order or the site to third parties without prior written consent.
- Insurance: The Plumber shall maintain adequate insurance cover, including public liability, employer's liability, and professional indemnity insurance, for the duration of this Purchase Order and for a further 12 months thereafter.
