5. Terms and Conditions
- This Purchase Order constitutes a binding agreement between Thameside Property Management Ltd (hereinafter "the Buyer") and Capital Plumbing & Heating Solutions Ltd (hereinafter "the Plumber / Supplier") upon acceptance and signature by both parties.
- The Plumber shall carry out all works in a workmanlike manner, using materials of the highest quality and in full compliance with all applicable United Kingdom legislation, including but not limited to the Health and Safety at Work etc. Act 1974, the Gas Safety (Installation and Use) Regulations 1998, and the Building Regulations 2010 (as amended) for England.
- All works shall be performed at the specified property address in United Kingdom London. The Plumber shall coordinate access with the Buyer's on-site representative and shall not commence works without prior written confirmation of access arrangements.
- The Plumber warrants that all workmanship shall be guaranteed for a minimum period of twelve (12) months from the date of practical completion. All supplied materials shall carry the manufacturer's standard warranty, which shall be transferred to the Buyer upon completion.
- Payment shall be made by BACS transfer to the Plumber's nominated bank account within thirty (30) calendar days of receipt of a valid VAT invoice. The Buyer reserves the right to withhold payment for any defective or incomplete works until rectification is satisfactorily completed.
- The Plumber shall maintain adequate public liability insurance (minimum £5,000,000) and professional indemnity insurance (minimum £1,000,000) for the duration of this Purchase Order. Certificates of insurance shall be provided to the Buyer prior to commencement of works.
- In the event of any dispute arising from this Purchase Order, both parties agree to first attempt resolution through mediation in accordance with the rules of the Centre for Effective Dispute Resolution (CEDR) in London, United Kingdom. Failing resolution, the matter shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- The Plumber shall comply with all health and safety requirements on site, including the provision of a Risk Assessment and Method Statement (RAMS) prior to commencement. All operatives shall be appropriately qualified, and the Plumber shall ensure that all gas-related work is carried out exclusively by Gas Safe registered engineers.
- Any variations to the scope of work outlined in this Purchase Order must be agreed in writing by both parties prior to execution. No additional charges shall be incurred without prior written authorisation from the Buyer's Facilities Director.
