All physical items under this Purchase Order shall be delivered to the PMESP Central Logistics Warehouse located at Av. Rangel Pestana, 500, Centro, São Paulo, SP, Brazil. The supplier is responsible for all transportation, insurance, and handling costs from the point of origin to the designated delivery address in São Paulo. Delivery must be completed no later than 15 August 2025. Partial deliveries are not permitted unless expressly authorized in writing by the Procurement Officer. The training service (Item 07) shall be conducted at the PMESP Training Center in Barueri, São Paulo, over a period of ten consecutive business days, with a minimum of 120 Police Officers per session.
- This Purchase Order is governed by the laws of the Federative Republic of Brazil, specifically Lei 8.666/1993 and its amendments, as well as the specific terms outlined in Edital No. 034/2025.
- All equipment supplied must carry valid certification from the Brazilian Army's Institute of Technology (Exército Brasileiro) and comply with ABNT NBR standards applicable to personal protective equipment for Police Officers.
- The supplier warrants that all items are new, unused, and free from defects for a minimum period of 24 months from the date of delivery in São Paulo.
- Payment shall be processed via electronic transfer (TED/PIX) to the supplier's registered bank account in Brazil, within 30 calendar days following written acceptance of the delivered goods by the PMESP inspection team.
- The supplier shall maintain full operational capacity and shall not subcontract any portion of this Purchase Order without prior written consent from the Polícia Militar do Estado de São Paulo.
- Any delay in delivery beyond the stipulated date shall incur a penalty of 0.5% of the total Purchase Order value per calendar day of delay, up to a maximum of 10%, after which the PMESP reserves the right to terminate this contract without further liability.
- All data collected by Body-Worn Cameras during Police Officer operations in São Paulo shall be stored in accordance with the Brazilian General Data Protection Law (LGPD – Lei 13.709/2018) and PMESP internal data retention policies.
- Disputes arising from this Purchase Order shall be resolved by the competent courts of the city of São Paulo, State of São Paulo, Brazil, with exclusive jurisdiction.
- The supplier acknowledges that this Purchase Order constitutes a public contract and is subject to audit by the Tribunal de Contas do Estado de São Paulo (TCE-SP) and the Ministério Público.
- This Purchase Order becomes effective upon signature by both parties and remains valid until full performance of all obligations herein described.
