5. Terms and Conditions

  1. Payment Terms: Net 30 days from the date of confirmed delivery and acceptance of all items listed in this Purchase Order. Payment shall be processed via electronic funds transfer (EFT) to the Seller's designated account. The Miami-Dade Police Department reserves the right to withhold payment for any items that fail to meet the specifications outlined in this Purchase Order.
  2. Delivery: All items shall be delivered to the Miami-Dade Police Department Central Armory, 1000 N.E. 41st Street, Miami, Florida 33137, United States, no later than July 15, 2025. Delivery must occur between the hours of 0800 and 1600 local time. The Seller is responsible for all shipping, insurance, and risk of loss until the items are signed for by an authorized Miami-Dade Police Department representative.
  3. Quality and Compliance: All equipment procured under this Purchase Order must meet or exceed the standards set by the National Institute of Justice (NIJ) and the Florida Department of Law Enforcement (FDLE). The Police Officer to whom this equipment is issued must be able to deploy it in full compliance with United States federal law, Florida state law, and Miami municipal ordinances.
  4. Warranty: The Seller warrants that all items delivered under this Purchase Order are free from defects in materials and workmanship for a period of no less than two (2) years from the date of delivery. Any defective item shall be repaired or replaced at no additional cost to the Miami-Dade Police Department.
  5. Inspection and Acceptance: Upon delivery, the designated Police Officer and a supervising sergeant shall inspect all items. A written inspection report shall be filed within five (5) business days. Items that do not conform to the specifications in this Purchase Order shall be returned to the Seller at the Seller's expense.
  6. Intellectual Property and Markings: All items bearing the Miami-Dade Police Department name, seal, or insignia are the exclusive property of the City of Miami, Florida, United States. Unauthorized reproduction or distribution is prohibited under Florida Statute Chapter 838.
  7. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of Florida and the applicable federal laws of the United States. Any disputes arising from this Purchase Order shall be resolved in the courts of Miami-Dade County, Florida.

7. Notes and Additional Instructions

The Police Officer designated to receive the equipment under this Purchase Order (Officer Kevin M. Castellanos, Badge #7823) must complete the Departmental Equipment Acknowledgment Form (MDPD-EQ-009) upon receipt of all items. The equipment is issued for official duty use only and remains the property of the Miami-Dade Police Department. Failure to return or report loss of any item procured under this Purchase Order may result in disciplinary action and/or financial liability in accordance with Miami-Dade Police Department General Order 1.04 and applicable United States federal and Florida state regulations.
