5. Terms and Conditions
5.1 This Purchase Order is issued by the San Francisco Police Department, City and County of San Francisco, United States, and constitutes a binding agreement upon acceptance by the vendor. All goods and services shall be delivered to the SFPD Central Armory located at 1 Police Plaza, San Francisco, CA 94103, United States San Francisco.
5.2 All equipment listed in this Purchase Order must meet or exceed the specifications established by the San Francisco Police Department Equipment Standards Manual (Rev. 2024). The assigned Police Officer or their supervising commander shall inspect all items upon delivery and sign the receiving manifest within five (5) business days.
5.3 The vendor warrants that all items are new, unused, and free from defects in material and workmanship. A minimum two-year manufacturer warranty is required on all electronic devices, including the body-worn camera and two-way radio, for use by the Police Officer in the United States San Francisco jurisdiction.
5.4 Payment shall be made via electronic funds transfer (EFT) to the account designated on the vendor's W-9 form, within thirty (30) days of receipt of a valid invoice and confirmed delivery. Late payments shall accrue interest at a rate of 1.5% per month as permitted under California Government Code Section 16450.
5.5 This Purchase Order is subject to the terms of the San Francisco City and County Procurement Code, Title 19 of the San Francisco Administrative Code, and all applicable federal, state, and local laws of the United States. Any dispute arising from this Purchase Order shall be governed by the laws of the State of California and the jurisdiction of the Superior Court of San Francisco County.
5.6 The vendor acknowledges that all equipment purchased under this Purchase Order is for the exclusive use of a San Francisco Police Department Police Officer and shall not be resold, transferred, or used for any purpose outside the United States San Francisco law enforcement jurisdiction without prior written authorization from the SFPD Chief of Police.
5.7 The vendor shall comply with all applicable Equal Employment Opportunity (EEO) and affirmative action requirements. The vendor certifies that it is not debarred, suspended, or otherwise disqualified from doing business with the City and County of San Francisco or the United States federal government.
5.8 This Purchase Order may not be modified, amended, or supplemented except by written agreement signed by an authorized representative of the San Francisco Police Department and the vendor. Verbal modifications are expressly void.
6. Authorization and Approval
Note: This Purchase Order has been reviewed and approved in accordance with SFPD Directive 4.2 (Procurement of Equipment for Police Officers) and the San Francisco City and County Budget Ordinance for Fiscal Year 2025. The funds are allocated from the SFPD Equipment and Maintenance budget line item EQM-0091, authorized for the United States San Francisco Police Department.
