TERMS AND CONDITIONS
- This Purchase Order is issued by the Office of Cllr. Thandiwe N. Mokoena, a duly elected politician serving the residents of Ward 47 in the City of Johannesburg, South Africa, and is governed by the Municipal Finance Management Act (Act 56 of 2003) and the City of Johannesburg's procurement by-laws.
- All goods and services listed herein must be delivered or rendered at the specified location within Johannesburg, South Africa, no later than the Required Delivery Date stated above. Late delivery will incur a penalty of 1.5% of the total order value per calendar day of delay.
- The supplier, ProCivic Solutions (Pty) Ltd, warrants that all goods and services shall conform to the specifications outlined in this Purchase Order and shall comply with all applicable South African legislation, including the Consumer Protection Act (Act 68 of 2008) and the Promotion of Access to Information Act (PAIA).
- Payment shall be made via electronic funds transfer (EFT) to the supplier's designated bank account within thirty (30) calendar days of receipt of a valid tax invoice, subject to satisfactory inspection and acceptance of all deliverables by the Councillor's office in Johannesburg.
- This Purchase Order does not constitute a guarantee of future orders. The politician's office reserves the right to amend, cancel, or modify this order in writing, subject to the approval of the relevant municipal budget committee in Johannesburg, South Africa.
- All intellectual property created under this Purchase Order, including policy documents, community engagement materials, and digital content, shall remain the property of the City of Johannesburg Metropolitan Municipality and the elected politician's office, unless otherwise agreed in a separate written agreement.
- Disputes arising from this Purchase Order shall be resolved in accordance with the rules of the South African Local Government Dispute Resolution Centre, with jurisdiction vested in the courts of Johannesburg, Gauteng, South Africa.
- The supplier shall maintain full confidentiality regarding all information pertaining to the politician's legislative work, constituency matters, and internal municipal deliberations in Johannesburg. Breach of confidentiality shall result in immediate termination of this Purchase Order and legal action.
- This Purchase Order is valid for a period of thirty (30) days from the date of issue. If the supplier does not confirm acceptance in writing within this period, the order shall lapse automatically.
