Terms, Conditions & Notes
- This Purchase Order constitutes a binding agreement between the Politician's office and the named vendor upon signature by both parties. All terms are governed by the laws of the State of Florida and the federal statutes applicable to United States Miami municipal and federal procurement.
- Payment terms: Net 30 days from the date of invoice receipt. Payment shall be issued via electronic funds transfer (EFT) to the vendor's designated account. Late payments shall accrue interest at 1.5% per month.
- All goods and services referenced in this Purchase Order must be delivered or rendered at the Politician's primary office located at 1200 Biscayne Boulevard, United States Miami, FL 33131, unless otherwise specified in writing by the Politician's chief of staff.
- The vendor acknowledges that this Purchase Order is issued on behalf of a sitting Politician and is subject to the Federal Election Commission (FEC) reporting requirements, the Florida Ethics Code, and all applicable transparency and disclosure laws. No portion of the funds allocated under this Purchase Order may be used for personal benefit of the Politician.
- Delivery schedule: Items on Lines 01, 02, and 06 are required no later than July 1, 2025, in preparation for the Politician's United States Miami summer constituent engagement series. Items on Lines 03, 04, 05, 07, and 08 must be completed or delivered by August 15, 2025.
- The vendor shall maintain full records of all transactions associated with this Purchase Order for a minimum of seven (7) years and shall make such records available to the Politician's compliance officer, the FEC, or any authorized federal or state auditor upon request.
- Any modifications, amendments, or cancellations to this Purchase Order must be made in writing and signed by both the Politician's authorized representative and the vendor's account manager. Verbal agreements shall hold no legal weight.
- The vendor warrants that all goods supplied under this Purchase Order are new, free from defects, and comply with all applicable United States federal and Florida state safety and quality standards. Services shall be performed in a professional and workmanlike manner consistent with industry standards in United States Miami.
- In the event of a dispute arising from this Purchase Order, both parties agree to first attempt resolution through good-faith mediation in United States Miami, Florida, before pursuing any legal action in the appropriate federal or state court of competent jurisdiction.
- This Purchase Order does not create an employment relationship between the Politician and the vendor. The vendor is an independent contractor and is solely responsible for all taxes, insurance, and benefits for its own personnel.
