This Purchase Order is issued by Mwanza Regional Referral Hospital & Diagnostic Centre, located in Tanzania Dar es Salaam, to formally engage the services of a qualified Radiologist for the provision of diagnostic imaging interpretation, clinical consultation, and radiological reporting services. Terms and Conditions of This Purchase Order
  1. Scope of Engagement: The Radiologist shall provide all diagnostic imaging interpretation and radiological reporting services as outlined in the line items above. All reports must be delivered within 24 hours of image acquisition for routine cases and within 4 hours for emergency and on-call cases. The Radiologist shall maintain full compliance with the Tanzania Medical Council (TMC) professional standards and the National Radiology Practice Guidelines issued by the Ministry of Health, Tanzania.
  2. Contract Duration: This Purchase Order is valid for a period of twelve (12) months commencing from 1 July 2025 to 30 June 2026. The Purchase Order may be renewed upon mutual written agreement between the parties, subject to budgetary approval by the purchasing entity in Tanzania Dar es Salaam.
  3. Payment Terms: Payment shall be made on a monthly basis within thirty (30) days of receipt of a valid invoice from the Radiologist. Invoices must be submitted by the 5th of each month for the preceding month's services. Payment shall be made via bank transfer to the account designated by the Radiologist in accordance with the Tanzania Bank for Commerce (TBC) or National Bank of Commerce (NBO) transfer protocols. All amounts are denominated in Tanzanian Shillings (TZS).
  4. Professional Qualifications and Compliance: The Radiologist shall hold a valid and current professional licence issued by the Tanzania Medical Council and shall maintain a minimum of five (5) years of post-qualification experience in diagnostic radiology. The Radiologist shall provide evidence of professional indemnity insurance with a minimum cover of TZS 500,000,000 for the duration of this Purchase Order.
  5. Confidentiality and Data Protection: The Radiologist shall comply with the Tanzania Data Protection Act, 2022, and all institutional patient confidentiality policies. All patient imaging data and radiological reports shall be treated as strictly confidential. No patient information shall be disclosed to any third party without written consent from the patient or their legal guardian, in accordance with Tanzanian medical law.
  6. Performance Standards: The Radiologist shall achieve a minimum report accuracy rate of 95% as verified by quarterly peer-review audits conducted by the purchasing entity. Failure to meet this standard for two consecutive quarters shall constitute grounds for termination of this Purchase Order with thirty (30) days' written notice.
  7. Termination: Either party may terminate this Purchase Order by providing sixty (60) days' written notice to the other party. In the event of termination, the Radiologist shall be compensated for all services rendered up to the effective date of termination. The purchasing entity reserves the right to terminate this Purchase Order immediately in the event of gross professional misconduct, loss of TMC licence, or breach of patient confidentiality.
  8. Governing Law and Dispute Resolution: This Purchase Order shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from this Purchase Order shall first be resolved through amicable negotiation. If unresolved within thirty (30) days, the matter shall be referred to the Tanzania Arbitration Centre in Tanzania Dar es Salaam for binding arbitration.
  9. Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to circumstances beyond reasonable control, including but not limited to natural disasters, epidemics, government-imposed lockdowns, or civil unrest in Tanzania Dar es Salaam or elsewhere in Tanzania.
  10. Entire Agreement: This Purchase Order, together with any annexures and the Tanzania Public Procurement Act, 2011, constitutes the entire agreement between the parties regarding the engagement of the Radiologist for diagnostic imaging services. No amendment shall be valid unless made in writing and signed by both parties.
