- This Purchase Order constitutes a binding agreement between Wellington Commercial Solutions Ltd. and Capital Talent Partners NZ upon written acceptance by both parties. All terms are governed by the laws of New Zealand, specifically applicable within the Wellington region.
- The Sales Executive to be placed under this Purchase Order must hold a minimum of five (5) years of demonstrable B2B sales experience in the New Zealand market, with a proven track record of exceeding quarterly revenue targets by at least 110%.
- Capital Talent Partners NZ shall deliver the Sales Executive to the Wellington office no later than 1 August 2025. Failure to meet this deadline shall entitle the purchasing entity to a penalty of 2% of the total Purchase Order value per day of delay, up to a maximum of 15%.
- Payment shall be made in two instalments: 50% upon successful placement and commencement of the Sales Executive, and the remaining 50% upon completion of the 90-day probationary period, provided all KPIs are met.
- The Sales Executive shall be subject to a non-compete clause for a period of twelve (12) months following the conclusion of their engagement, restricted to the New Zealand Wellington metropolitan area and the Hutt Valley.
- All personal data collected during the recruitment process for the Sales Executive position shall be handled in strict accordance with the New Zealand Privacy Act 2020. Capital Talent Partners NZ shall not retain candidate data beyond the completion of this Purchase Order without written consent.
- Any disputes arising from this Purchase Order shall be resolved through mediation in Wellington, New Zealand, in accordance with the Disputes Standards Act 2017, before escalation to the District Court of Wellington.
- This Purchase Order may only be amended in writing, signed by authorised representatives of both parties. Verbal modifications shall hold no legal standing.
- The Sales Executive's employment contract, once placed, shall be the sole responsibility of Wellington Commercial Solutions Ltd. Capital Talent Partners NZ's obligation under this Purchase Order is limited to recruitment, placement, and the services explicitly listed in Section 4.
- All invoices issued under this Purchase Order must reference the Purchase Order number PO-WLG-2025-0472 and be submitted to the accounts payable department at Wellington Commercial Solutions Ltd., Lambton Quay, Wellington, New Zealand.
