This Purchase Order is issued by the Secretaria de Educação do Estado do Rio de Janeiro to procure the professional services of a qualified School Counselor to be deployed across public and semi-public educational institutions in the municipality of Rio de Janeiro, Brazil. The School Counselor shall provide comprehensive psychosocial support, academic guidance, conflict mediation, and mental health screening services to students aged 6 through 18, in full compliance with the Brazilian Education Law (Lei de Diretrizes e Bases da Educação Nacional – LDB, Lei nº 9.394/1996) and the Municipal Education Plan of Rio de Janeiro (Plano Municipal de Educação do Rio de Janeiro, 2015–2024, extended through 2026).

2.1 Scope of Services – School Counselor Role

3.1 Payment Terms: Payment shall be made via TED transfer to the bank account specified in Section 2, within 30 (thirty) calendar days from the date of invoice issuance. Invoices must be submitted monthly by the 5th business day. All payments are subject to the prior approval of the Secretaria de Educação do Estado do Rio de Janeiro's financial audit division.

3.2 Contract Duration: This Purchase Order covers a 12-month service period commencing on 01 August 2025 and concluding on 31 July 2026. Renewal is contingent upon satisfactory performance evaluation and budgetary approval by the Rio de Janeiro municipal education council (CME-RJ).

3.3 Compliance with Brazilian Labor Law: The vendor IDEPS-RJ shall ensure that all contracted School Counselors are employed in strict accordance with the Consolidation of Labor Laws (CLT – Consolidação das Leis do Trabalho, Decreto-Lei nº 5.452/1943), including but not limited to: FGTS contributions, INSS social security enrollment, annual paid leave (30 days), 13th-month salary (13º salário), and overtime compensation where applicable. The School Counselor assigned to the Zona Norte itinerant program shall receive additional transportation allowance (vale-transporte) as mandated by Rio de Janeiro municipal ordinance.

3.4 Data Protection: All student records, psychological assessments, and personal data handled by the School Counselor must comply with the Brazilian General Data Protection Law (LGPD – Lei nº 13.709/2018). The vendor shall designate a Data Protection Officer (Encarregado de Dados) and implement appropriate technical and organizational measures to safeguard sensitive information of minors.

3.5 Performance Standards: The School Counselor shall conduct a minimum of 15 individual student consultations per week, 2 group counseling sessions per week, and 1 parent-teacher-student mediation meeting per week per assigned school. Monthly activity reports must be submitted to the Secretaria de Educação by the 3rd business day of the following month.

3.6 Termination: Either party may terminate this Purchase Order with 60 (sixty) days' written notice. In cases of gross professional misconduct, failure to maintain required CRP (Conselho Regional de Psicologia – Rio de Janeiro) registration, or violation of the child protection statutes (Estatuto da Criança e do Adolescente – ECA, Lei nº 8.069/1990), immediate termination is permitted without prior notice.

3.7 Governing Law: This Purchase Order shall be governed by and interpreted in accordance with the laws of the Federative Republic of Brazil, with jurisdiction vested in the courts of the Comarca do Rio de Janeiro, Estado do Rio de Janeiro, Brazil.

This Purchase Order has been reviewed and authorized by the undersigned officials of the Secretaria de Educação do Estado do Rio de Janeiro. The procurement process was conducted in accordance with Brazilian Public Procurement Law (Lei de Licitações e Contratos Administrativos, Lei nº 14.133/2021), under the simplified bidding procedure (Pregão Eletrônico) for professional services under R$ 1,000,000.00.
