- This Purchase Order constitutes a binding agreement between the Issuing Authority and the Service Provider for the engagement of a School Counselor within the jurisdiction of Venezuela Caracas. Both parties acknowledge and agree to comply with all applicable laws of the Bolivarian Republic of Venezuela, including the Ley Orgánica de Educación, the Ley de Protección del Niño, Niña y Adolescente (LOPNNA), and the regulations issued by the Banco Central de Venezuela regarding financial transactions.
- The School Counselor engaged under this Purchase Order shall maintain strict confidentiality regarding all student records, session notes, and personal information in accordance with Venezuelan data protection standards and the ethical code of the Colegio de Psicólogos. Any breach of confidentiality shall result in immediate termination of this Purchase Order and potential legal action.
- The Service Provider guarantees that the School Counselor assigned to this contract shall not be simultaneously engaged in any other institutional counseling role within the Caracas metropolitan area that would create a conflict of interest or compromise the availability required under this Purchase Order.
- Payment shall be processed in Venezuelan Bolívares (VES) via bank transfer to the account designated by the Service Provider. - This Purchase Order may be terminated by either party with a written notice of thirty (30) calendar days. - All disputes arising from this Purchase Order shall be resolved through arbitration in Caracas, Venezuela, in accordance with the Ley de Arbitraje de la República Bolivariana de Venezuela. The competent courts of the Distrito Capital shall have jurisdiction in the absence of an arbitration agreement.
- The School Counselor shall participate in at least two (2) professional development workshops per academic year, organized by the Ministry of Education of Venezuela, to ensure continuous improvement of counseling methodologies and alignment with national educational policies.
